Employees of U.S. companies working in foreign countries are not covered by federal overtime laws, said Ian Scharfman, a lawyer with Shellist, Lore & Lazarz.
Congress specially excluded them from the overtime laws, said Scharfman, who isn't connected to the case.
"The language of the statute is pretty unambiguous,'' added Chip Galagaza, a lawyer with Seyfarth Shaw in Houston, who also is not connected to the case.
On Friday afternoon, Salar Ali Ahmed, a lawyer who is representing Smith, said he was discussing the issue with his co-counsel, Melissa Ann Moore. Later, he called to say he was dismissing the case.
"And that's all I'm going to say,'' Ahmed said. "Just don't print anything.''
