Newfoundland Court Hears Gay Marriage Challenge

Legal arguments began Monday in the Newfoundland Supreme Court in a case involving two lesbian couples seeking the right to marry in Canada's most eastern province.

Jacqueline Pottle and Noelle French were twice been denied a marriage license last fall. Lisa Zigler and Theresa Walsh were denied a license in October.

The court has scheduled two days for arguments.

1. Why not?

"I personally favor having a system that respects both the religious definition, traditional definition, while at the same time puts in place a civil union that ensures that the rights, privileges, protections and responsibilities that flow from marriage are treated equally under the law.

"Just last week, South Africa expanded civil marriage to include same-sex couples. Spain will soon follow. Around the world, people are realizing that discrimination against lesbian and gay people is just plain wrong. Here in Canada, same-sex couples have been marrying for over a year and a half, and support for equal marriage is higher than it's ever been."

2. It just stopped being a "challengeable" item last month.

Supreme Court of Canada ruled that gay marriage discrimination was a violation of the Charter of Human Rights. They told the Federal Parliament to get off of it and start legislating protection in the next session.
