Charges were filed in November after another soldier in Werst's squad told Army criminal investigators about Ismail's killing,
after which Werst allegedly planted a handgun on the dead man to make the shooting appear as self-defenseAccording to Elliott, Stewart told investigators that Ismail was separated from his family and taken to another part of his house. The Iraqi was thrown to the ground, where Werst and Stewart beat him with their fists and a metal flashlight. "We're going to kill this (expletive)," Stewart quoted Werst as saying.
Stewart said Werst ordered him to lift Ismail to his feet, and once the man was standing, Werst shot him several times with his Army rifle. The sergeant shot Ismail again when he was lying on the floor, Stewart reportedly said in his statement. After the shooting, Stewart told investigators, Werst pulled out a 9-millimeter handgun, fired it twice and then told Stewart to put into Ismail's hand.
