Officials: Ohio Supreme Justice Fails Sobriety Test

COLUMBUS, Ohio -- A state Supreme Court justice was arrested and charged with operating a motor vehicle under the influence after several motorists called to report an erratic driver on an interstate.

Justice Alice Robie Resnick also was charged with driving outside marked lines, a minor misdemeanor.

Lt. Rick Zwayer, a State Highway Patrol spokesman, said Resnick, 65, of Toledo, was pulled over on I-75 south of Bowling Green. He said she failed field sobriety tests and was arrested at 2:02 p.m. Monday in Wood County in northwest Ohio.

Resnick could not be reached for comment last night, according to The Columbus Dispatch. Chris Davey, a spokesman for the Supreme Court, declined to comment.

Ohio Supreme Court Justice Alice Robie Resnick was charged with operating a motor vehicle while under the influence and driving outside marked lines yesterday in Wood County.

The 2:02 p.m. arrest by the State Highway Patrol followed several cellphone calls from motorists reporting an erratic driver on southbound I-75, according to Lt. Rick Zwayer, a patrol spokesman.

Resnick, 65, of Toledo, was pulled over near Rt. 6 south of Bowling Green, where she failed field sobriety tests, Zwayer said.

Resnick was taken to the patrol’s Findlay post, where she refused to take a test of her bloodalcohol content, Zwayer said. That led to the charge of operating under the influence, a firstdegree misdemeanor. The marked-lanes violation is a minor misdemeanor.

40. Actually, I've read that if stopped for DUI you should

ask for a pre-arrest breath analyzer test, if you think you might be able to pass it. My understanding is this test is not admissible so if you fail you can then decline to be tested. But this was several years ago and laws change and are different in some locations.

Also from the same article was if you KNOW you are going to fail you should decline any tests and take the suspension. Your chance of beating the rap gets much better without that prove positive test hanging over your head.

My advise is TAKE A CAB DUMMY, or walk or get a hotel room but DON'T DRIVE DRUNK. Of course my advise may be worth the price paid.

But it does seem odd to me that a person would have such a big alcohol problem to be weaving all over the road so badly as to prompt several other motorists to phone in the HP at 2:00 in the afternoon and yet have the length and depth of a successful enough career to have gotten to the level of a State Supreme court judge - and a public enough career that she was constantly surrounded by people, yet they either didn't notice habitual drunkenness or the attending rumors never spread far enough to hinder her promotions?

Yes, I'm assuming that a person in this case would have an ongoing problem with alcohol - it could certainly turn out to be the case that up until that day she was a complete tea-totaler - maybe that's why she was so influenced in the middle of the day.

They have shown the video from the HP AFTER they had talked to her and she had illegally driven away from them. She is a hazard. There were 6 different cell phone calls about here driving. She was unsteady on her feet and slurring her words on the video. Then, she blew a .0218!! in the field Breathalyzer. That is HUGE! Not a glass of wine, more like 7 martinis in rapid succession. This was not an oversight during lunch, this was power drinking.

On the first offense you have to put a yellow tag on every car you own, including your wifes and all work vehicles you drive. I am waiting for the day half the cars on the street have yellow tags. Justice Alice Robie Resnick is the fourth woman elected to statewide office in Ohio and the second woman elected to the Supreme Court of Ohio. She was first elected to the Supreme Court in 1988, and was re-elected in 1994. Justice Resnick was the founder and co-chair of the Ohio State Bar Association/Supreme Court of Ohio Joint Task Force on Gender Fairness. This task force addressed issues such as gender bias in the courts; lawyer and workplace life styles; gender bias education; and gender issues in domestic relations cases. A Final Report was issued in May 1995. From 1998 to the present time, Justice Resnick has chaired the Ohio Women’s Legal Assistance and Education Coalition. Through its three committees, the Gender Fairness Implementation Committee, the Legal Assistance and Education Centers Committee, and the Legal Rights Handbook Committee, the coalition seeks to assist and inform women in Ohio regarding their legal rights.

Justice Resnick was born on August 21, 1939 in Erie, Pennsylvania. She resides in Toledo with her husband, Judge Melvin L. Resnick, who sits on the Ohio Sixth District Court of Appeals. She has three step-children, six step-grandchildren, and three dogs, one of which is a rescued greyhound.

Our local rep resigned under a cloud of illegal, self-serving transactions, but there has never been a charge; not even a story in the paper. Before Supreme Court Justice Alice Robie Resnick was charged with operating a motor vehicle under the influence Monday, she drove away from state troopers and local police who asked her to submit to field sobriety tests.

When she ultimately agreed to a portable breath test — which is not admissible as evidence in court — it registered 0.216, more than twice Ohio’s legal limit.

At least six motorists called 911 about a gold Jeep Grand Cherokee weaving along southbound I-75 about 2 p.m., nearly sideswiping one vehicle. Resnick’s state-owned 2001 Jeep Grand Cherokee matches that description.

Resnick pleaded no contest and was convicted in July of failure to control and weaving in Toledo after the gold 2002 Cadillac DeVille she was driving ran into the back of another vehicle at a traffic light. Public records also show she has been involved in two other accidents since 1998 in Lucas County, although she apparently was not cited in either.
