Charges reinstated against mayor who married gay couples

ALBANY, N.Y. A New York judge has reinstated criminal charges against a small-town mayor who got in trouble for marrying gay couples last year.

New Paltz Village Mayor Jason West married about two dozen same-sex couples. West was quickly hit with 24 misdemeanor counts but the charges were later dismissed.

But Ulster County Court Judge Michael Bruhn brought back the charges today, saying public officials cannot pick and choose which laws to obey.

The case will now go to trial, barring a settlement or a successful appeal by West's lawyers. West faces fines and up to a year in jail if convicted on the misdemeanor counts of solemnizing marriages without a license.

He has maintained he was upholding the couples' constitutional rights.

4. DOMA

failed 4 times in New York with REPUBLICAN controlled Legistlature. The marriage laws here do not say one man and one woman, rather bride and groom (my marriage license says that) and spouses. A very GOOD lawyer is needed here. Might be able to make the case.
