Gonzales Added to War Crime Complaint in Germany
CCR Says Attorney General Designate’s Testimony before the Senate Confirms His Role in Abu Ghraib Torture

Synopsis

CCR filed new documents on January 31, 2005, with the German Federal Prosecutor looking into war crimes charges against high-ranking U.S. officials including Donald Rumsfeld: one includes new evidence that the Fay investigation into Abu Ghraib protected Administration officials – it is a comprehensive and shocking opinion by Scott Horton, an expert on international law and the Chair of the International Law Committee of the Association of the Bar of the City of New York. The second is a letter that details how Attorney General nominee Alberto Gonzales’s testimony before the Senate Judiciary Committee confirms his role as complicit in the torture and abuse of detainees in Abu Ghraib and elsewhere in Iraq.

Description and Status

In a declaration filed with the prosecutor in Karlsruhe, Germany, Scott Horton, who was asked to consider whether or not the U.S. would conduct a genuine investigation up the chain of command for war crimes, unequivocally states that “…no such criminal investigation or prosecution would occur in the near future in the United States for the reason that the criminal investigative and prosecutorial functions are currently controlled by individuals who are involved in the conspiracy to commit war crimes.” One of the legal issues before the prosecutor is whether the German investigation should be dismissed or deferred so that the U.S. authorities have a chance to conduct their own investigation. The obvious answer from Horton’s affidavit is no. The impossibility of an independent and far-reaching domestic investigation of high-ranking U.S. officials coupled with the United States’ refusal to join the International Criminal Court make the German court a court of last resort.

5. They all know they're wanted for crimes now
they may not be brought to justice for 10 years after they leave office. But they will never be safe from arrest after they leave office in any country outside the U.S. Maybe one day there will be an administration in office in the U.S. that will do the right thing and extradict them to stand trial for their crimes.

7. What the hell legal authority does the German government and
its courts have? None. So why the hell is CCR filing this bogus crap? Publicity? Solicitation for money or in kind "donations?" Or just to make noise about a lousy bunch of idiots who are in charge of America's government? All in all, this stupidity has no legal teeth, period.

exactly what jurisdiction did they have in 1943 when they started gathering the material that ended up being presented by the prosecution at Nuremberg> I am sure the IMT was also a waste of time

11. Please read the article, the complaint, the German laws . . .
that are purported to have jurisdictional authority which is what is at issue. You are addressing a collateral issue.

9. Pretty soon none of them
will be able to travel outside the U.S. It's going to get tougher and tougher to "spread freedom" around the world, when they're seen as war criminals. Then again, we already know they don't care what the rest of the world thinks.

15. Hopeful yet sad
I could never have imagined a sitting US cabinet Secretary or higher even being wanted on open international warrants for arrest.

On the other hand, considering who these particular sitting officials are, I am delighted.

As to jurisdiction, why is Rummy reported to be reconsidering his planned trip to Germany if there are no jurisdictional problems?

To the Dock with the lot of them ..... and then leg irons and special cells ..... ideally in Hell.

Fuck them all.
