THREE City bankers facing extradition to the US over the Enron scandal are seeking judicial review of a decision by British anti-fraud officials.
David Bermingham, Gary Mulgrew and Giles Darby are challenging a decision by the Serious Fraud Office (SFO) not to prosecute them in Britain. The SFO took the view that the American authorities “had a stronger call on the matter”.
The application for judicial review was lodged in the High Court yesterday. The men will argue that the decision of Robert Wardle, SFO director, not to prosecute them, was wrong in fact and in law.
The three men say that they are innocent but are concerned that they would be denied a fair trial in the US. The alleged crime took place largely in the UK and against a British victim.
