WASHINGTON (AP) — The FBI would get expanded powers to subpoena records without the approval of a judge or grand jury in terrorism investigations under Patriot Act revisions approved Tuesday by the Senate Intelligence Committee.
Opponents said the new powers, part of the Bush administration's effort to renew and expand the 2001 law, violated basic civil rights.

Sen. Dianne Feinstein, D-Calif., said she voted against the bill in a closed committee meeting because it left open the possibility that such power could be used in criminal, rather than intelligence-gathering, inquiries.

The panel rejected one amendment that would have required that investigations have "as a significant purpose the collection of intelligence."

The American Civil Liberties Union released a statement criticizing both the substance of the bill and the closed-door meetings to write it.

"Americans have a reasonable expectation that their federal government will not gather records about their health, their wealth and the transactions of their daily life without probable cause of a crime and without a court order."

Senate Intelligence Committee Chairman Pat Roberts, R-Kan., and the panel's ranking Democrat, Sen. Jay Rockefeller, D-W.Va., had no immediate comment.

The bill also must be considered by the Senate Judiciary Committee, where Feinstein and other Democrats planned to again offer their amendments.

The non Neo-Con Southern Seantors (Trent Lott, Thad Cochran, etc).

Trust me, a lot of the south (and R voting south) doesn't want the FBI anwhere near them, and certainly doesn't want to give them more power. This is a dixiecrat split issue, as many southerners still remember the FBI locking ppl up and federal troops being used here.

Not saying they will all buy into it, but if the party or others run advertising, I don't think it will take much to get many southern senators to tell the FBI to go to hell.

"This bill must be amended on the floor to protect national security while protecting Constitutional rights," said Sen. Barbara Mikulski (news, bio, voting record), D-Md.

Ranking Democrat Jay Rockefeller, D-W.Va., supported the bill overall but said he would push for limits that would allow such administrative subpoenas "only if immediacy dictates." Rockefeller and other committee members, such as Sen. Dianne Feinstein (news, bio, voting record), D-Calif., also are concerned that the bill would grant powers to federal law enforcement agencies that could be used in criminal inquiries rather than intelligence-gathering ones.

Committee Chairman Pat Roberts, R-Kan., said the bill places new checks and balances on the powers it would grant, such as new procedures that would allow people to challenge such administrative orders. He called the Patriot Act "a vital tool in the war on terror" and lauded the Democrats who voted for it in spite of misgivings.


Thank God that Democrats had some "misgivings" about decimating the 4th Amendment! Otherwise we might not be able to tell the difference between their yes votes and those of the Repukes praising their "courage"!

BTW if any of Nader's supporters are reading this, please know that I ask for your forgiveness. No politician is "pure" but Ralph Nader had it right when I was still in denial, compromising my standards and holding my nose to vote for Kerry instead of Nader.
