Nurses win court decision in hospital-staffing case (Schwarzenegger lost)
Gov. Arnold Schwarzenegger acted illegally in seeking to overturn portions of state law requiring registered-nurse-to-patient hospital ratios, Sacramento County Superior Court Judge Judy Hersher ruled Tuesday.

In upholding a lawsuit by the California Nurses Association, Hersher issued a permanent injunction overturning two emergency regulations by Schwarzenegger to suspend parts of the ratio law, the controversial Assembly Bill 394, signed by former Gov. Davis in October 1999.

The emergency regulations, Hersher ruled, exceeded the administration's scope of authority and were made without sufficient evidence. The administration, said Hersher, "abused its discretion and failed to follow the procedures established by law in determining the regulations were necessary for the immediate preservation of public health and safety."

Deborah Burger, a registered nurse and president of the California Nurses Association, said, "Today's decision sends a compelling, unmistakable message that this governor is not above the rule of law, and that a law enacted to protect patients may not be sabotaged simply to financially benefit his hospital corporate donors."

The situation is so bad, Gordon writes in "Nursing Against the Odds," a gloomy assessment of American nursing, that even nursing educators, the people we rely on to train the next generation of nurses, are leaving the field, so nursing schools cannot accommodate declining numbers of would-be students.

Gordon, a journalist who specializes in nursing issues, is hardly the first person to make these points. The cost-cutting of managed care has been notoriously hard on nurses, whose salaries loom large on the hospital bottom line.

But these are not the only issues in her book. Issues of respect and regard must also be dealt with if the nursing crisis she sees is to be addressed. And these issues, she writes, will never be solved unless nursing as a profession comes to grips with them

17. Nah, nurses are far too professional
They'd never do anything to retaliate against Ah-nuld. Although, yes, it is too bad the examination room right here is unusable, and yes, you do have to walk all the way down the hall with your flabby man buttocks hanging out the back of your johnnie, it's the only one left in the supply closet, too bad it's kind of small, but you know how it is, and yes, the air conditioning does need to be cranked up that high, keeps the medicines on the floor fresh, you know, and no, I'm afraid you can't have your own slippers, and these little disposable booties are all we have.

The Associated Press

SACRAMENTO, Calif. Jun 7, 2005 — A judge Tuesday upheld a first-in-the-nation law requiring hospitals to have at least one nurse for every five patients.

The Schwarzenegger administration and California Hospital Association both vowed to appeal.

Sacramento County Superior Court Judge Judy Holzer Hersher said the administration erred when it issued an emergency order last November trying to delay the state law requiring hospitals to provide more nurses.

24. Hurray for the health and safety of the public!
These staffing ratios have a direct impact on patient health and safety. This is a win for anyone who might ever be hospitalized - ie everyone! :)

Hurray for nurses too of course - I just didn't want people to overlook the main issue here.

There are just a few groups in society that you just can't mess with, because public opinion will almost certainly turn against you. Nurses are one of those groups. There isn't one among us who hasn't required, and appreciated, the services of a nurse at one time or another.

His remarks were also meant for the state's teachers, police and firefighters who have good reasons to oppose him. . .
