Prosecutor: No Criminality In Schiavo Collapse; Bush Ends Inquiry

POSTED: 6:22 pm EDT July 7, 2005
UPDATED: 6:26 pm EDT July 7, 2005

TALLAHASSEE, Fla. -- There is no evidence that Terri Schiavo's collapse 15 years ago involved criminal activity, said a prosecutor asked by Gov. Jeb Bush to look into the case.

Bush, who asked State Attorney Bernie McCabe to further investigate Schiavo's case after her autopsy last month, responded Thursday by saying he considers the state's involvement with the matter finished. "Based on your conclusions, I will follow your recommendation that the inquiry by the state be closed," Bush said in a two-sentence letter.

In asking McCabe to look again into what put Schiavo in a persistent vegetative state, Bush had cited an alleged gap in time between when Schiavo's husband Michael found her and when he called 911 as something that remained unsettled.

McCabe said, however, that while such discrepancies may exist in the record, Michael Schiavo's statements that he called 911 immediately had been consistent.

8. If I were Mr. Schiavo...
I'd sue too. He did what was right, which was to work to free her from a body that she wasn't living in anymore. A lot more humane than what her own blood relatives or her government bothered to do.

What Jeb et al said account to slander. Just goes to show that shooting from the lips is a common trait in the Bush family.

Mark Furhman (of the O.J. trial) has now written a book called "Silent Witness" or something like that.

He was on some Fox show (I think Hannity) the other night with the Schindlers basically saying that there was foul play, etc.

Made me sick . . .

20. I would hope so. Terri needs to be able to rest in peace without
being a political football. Michael Schiavo needs to be able to go on without these threats over his head. I hope Mark Fuhrman's book (spurred on by Sean Hannity) sinks to the bargain books or out of the stores altogether quickly. Other than Fox News, I haven't seen the news organizations even covering it.

22. No Crime Found In Schiavo Collapse(Jeb says case closed)
http://www.cbsnews.com/stories/2005/07/07/national/main707452.shtml

(AP) Florida's state attorney said there was no evidence Terri Schiavo's collapse 15 years ago involved criminal activity, and Gov. Jeb Bush on Thursday declared an end to the state's inquiry.

Bush had asked State Attorney Bernie McCabe to investigate Schiavo's case after her autopsy last month. He said he now considers the state's involvement with the matter finished.

"Based on your conclusions, I will follow your recommendation that the inquiry by the state be closed," Bush said in a two-sentence letter.

When Mr. Schiavo called 911, Jeb was waiting for him. He re-routed the call to make sure the ambulance would be too late to help her and 15 years later, he could use her as a political prop.

:sarcasm:

Honestly, given the lack of outrage from the "Christian, Family Values" crowd over Cheney the Dick's use of the F-bomb on the floor of the Senate, it's pretty clear that the "War on Terra" is really a War on Truth, and the REAL obscene four-letter f-word is FACT.
Facts are terrifying to Rethugs, because facts contradict their sorry little ideology.

Florida Closes Its Inquiry Into Collapse of Schiavo

(snip)

David Gibbs, a lawyer for Ms. Schiavo's parents, Robert and Mary Schindler, said the report appeared rushed. Mr. Gibbs noted that the Schindlers had not been interviewed by the state attorney's office. "We had thought they would meet with the family," he said.

Michael Schiavo's lawyer deferred comment pending a chance to review the report fully.

Why would they meet with the family? The State Attorney would look at EVIDENCE...no need to get into the emotional ramblings of family members who were not there when Terri collapsed.

He should sue the a$$ off jeb and frist, then demand a public apology as a term of the lawsuit.
They slandered and libeled him repeatedly.
I know there are never any real winners in a drawn-out tragedy like this, but jeb and frist should be made to lose from this.
They need to pay big time for the callous slander they heaped on this unfortunate man - all in the hopes of making political hay from his family's tragic misfortune.

53. Here's the entire report from the State Attorney:
http://www.sptimes.com/2005/07/08/Tampabay/Result_of_the_State_A.shtml

(snip)

Understandably, Michael Schiavo is not the only witness who has been inconsistent or had difficulty recalling the timing of events surrounding Terri's collapse and resuscitation. Shortly after finding Terri, Michael Schiavo called his in-laws and told them what happened. It is unclear whether he or the Schindlers called Bobby Schindler who lived in the same complex as Michael and Terri and who immediately went to their apartment and arrived before the paramedics. Although Terri's parents had been awakened in the middle of the night with extremely disturbing news and waited at their house for a subsequent phone call on their daughters condition, they have no clear idea what time they were called by Michael. They had previously provided our office a timeline indicating that they were called as early as 3-4 a.m. but recently told Thogmartin they could not recall the time. Similarly, Terri's brother, Bobby Schindler, told Dr. Thogmartin he could not remember the time that he was called or initially arrived at the Schiavo residence except in relation to the arrival of the paramedics.

(snip)

…The most obvious explanation is also the most logical: under the extremely stressful circumstances his attention to and memory of the exact time were faulty - in the same way that the recollections of Mr. and Mrs. Schindler and Bobby are flawed.

(snip)

Family members and others who disagreed with Mr. Schiavo's decision to seek court approval to have his wife's feeding tube removed have made repeated attacks on his credibility and accused him of mistreatment of his wife. At least some of these accusations have been shown to be baseless by the autopsy conclusions. We should note, however, that we have also received unsolicited comments praising his honesty, sincerity and devotion to his wife's care. Also, when asked about her son-in-law during the 1992 malpractice trial, Mary Schindler testified, "He's there every day. She (Terri) does not want for anything. He is loving, caring. I don't know of any young boy that would be as attentive. He is ... he's just unbelievable, and I know without him there is no way I would have survived this."

(snip)

We strongly recommend that the inquiry be closed and no further action be taken.
