Judge: Punk landmark CBGB's can't be evicted (CNN)

NEW YORK (AP) -- A civil court judge ruled Wednesday that the landmark punk club CBGB's can't be evicted from its Bowery location, saying it shouldn't be punished for not noticing it owed its landlord money.

The ruling was a victory for the club where groups like the Ramones and Blondie defined the punk scene in the 1970s, but CBGB's future is still uncertain.

Its lease with the Bowery Residents' Committee expires on August 31, and a renewal remains up in the air.

...but why would a judge conclude that they can't be evicted for not noticing they owed their landlord money? Seems like kind of a lame excuse....

CBGB's was one of the landmarks I couldn't miss on my vacation to NYC this summer. I got my picture taken on stage (during the day). My 19-year old son was so jealous when he saw the pictures. He couldn't go with us, but I thought he needed to see his old mom being cool. Also I could tell him what OMFUG means.

My son's band just played there on July 27th. He was so excited because it was the legendary CBGB, I got to stream it live online, so I didn't miss a beat.

which is probably what saved them in the judge's eyes. It isn't as though they refused to pay up.
