DeLay Indicted in Campaign Finance Probe / Delay is stepping down as ML
Edited on Wed Sep-28-05 11:58 AM by Pirate Smile
WASHINGTON - A Texas grand jury on Wednesday charged Rep. Tom DeLay and two political associates with conspiracy in a campaign finance scheme, an indictment that could force him to step down as House majority leader.

DeLay attorney Steve Brittain said DeLay was accused of a criminal conspiracy along with two associates, John Colyandro, former executive director of a Texas political action committee formed by DeLay, and Jim Ellis, who heads DeLay's national political committee.

The indictment against the second-ranking, and most assertive Republican leader came on the final day of the grand jury's term. It followed earlier indictments of a state political action committee founded by DeLay and three of his political associates.

The grand jury action is expected to have immediate consequences in the House, where DeLay is largely responsible for winning passage of the Republican legislative program. House Republican Party rules require leaders who are indicted to temporarily step aside from their leadership posts.

http://news.yahoo.com/s/ap/20050928/ap_on_go_co/delay_investigation;_

Banner on CNN website - "House Majority Leader Tom DeLay indicted on one count of criminal conspiracy by Texas grand jury, according to Travis County clerk's office."

http://www.cnn.com/

House Republican Rule - if you are indicted, you have to step down from the Leadership. They changed the rule and then changed it back, so will Tommy step down.

Would it be temporary or permanently? CNN is saying it would be stepping down from his leadership position, not his House seat and it would probably be temporary - unless the Republicans decide to go back on the rule like Bush did re firing anyone connected with leaking Plame's name.

The jabber on MSNBC is that David Drier may be taking over the Majority Leader position - they are sourcing it to AP.

MSNBC just reported that Delay WILL STEP DOWN as Majority Leader.

Edit to add - link to article and additional information as it comes out.

498. Here is an idea:
Remember this WP article?

Only hours after Rep. Roy Blunt was named to the House's third-
highest leadership job in November, he surprised his fellow top
Republicans by trying to quietly insert a provision benefiting
Philip Morris USA into the 475-page bill creating a Department of
Homeland Security, according to several people familiar with the
effort.

The new majority whip, who has close personal and political ties to
the company, instructed congressional aides to add the tobacco
provision to the bill -- then within hours of a final House vote --
even though no one else in leadership supported it or knew he was
trying to squeeze it in.

Once alerted to the provision, Speaker J. Dennis Hastert's chief of
staff, Scott Palmer, quickly had it pulled out, said a senior GOP
leader who requested anonymity. Majority Leader Tom DeLay (R-Tex.)
also opposed what Blunt (Mo.) was trying to do, the member said,
and "worked against it" when he learned of it.

That's what all the convicts said (Rostenkowski, apprehended and convicted; John Mitchell >AG Nixon, apprehended and convicted; Donald Segretti >dirty trickster funded by Nixon slush fund, apprehended and convicted; &c) and yet civil rights - unlike the Patriot Act, pushed by DeLay - requires that one is innocent until proven guilty.

The ironies are ineffable.*

Call it a hunch, but I doubt Tommy-boy will "sing" per se. His lawyers already knew this was a possibility, and will no doubt do everything in that sleazebag's power to get his carcass out of this.

Until Tom actually gets convicted, does the perp walk in full handcuffs, and his TX district starts their election for his replacement in the House, I'm treating this no differently than Rove's status as the CIA-leaker.

HOWEVER, if/when Tommy-boy DOES go down......I'll do a little dance, make a little love and get down tonight!

The laws of physics have to start kicking in some time. They can only spin so fast until they start to break up. Katrina, Delay and if there's any sort of Karmic timing, Rove etal. in the Plame investigation. The trifecta! Pretty soon the entire thing will be spinning so fast it'll shatter into thousands of little pieces never able to be a whole again! Sweeeeeeeet!

I'm an Australian, don't know nuthin' about the legal system in the US (apart from what I see on Law & Order), and I'd like to know who actually draws up an indictment for impeachment? Does it take someone like Kenneth Starr to investigate, is his a partisan appointment, and who sets a hound like that on the trail? I'd love to see a row of falling dominos skittling a few conservatives out this way, too. because they picked Fitzgerald via the asst AG who did the appointment because Ashcroft backed off. There are a lot of people who believe that because Fitzgerald indicted Gov Ryan of IL (an R)that he will act just as independently on the Plame case. This is a different league in DC. Rove and Bush** knew what they were doing when the selection was made.

245. Actually, I think the fact that the Republicans attempted to change
the rule so that indicted members do not have to step down makes it look as though they knew what might come down the pike.

And of course many DID know.

It puts me in mind of other ways the Repub's attempt to inoculate themselves against justice. Like, make the country so sick and weary of even the thought of another impeachment when you know you will be in the White House next cycle via stolen elections.

When you know full well you will be doing things that would make the nation's founder's turn in their graves.

467. Even if not convicted, re-election is out IMHO
He got into the tightest race of his political life last year when there was no indictment, I think his sorry ass will be gone if he runs again. Their best bet would be for him to not run again and put up another repuke, I think DeLay will lose any race he gets into at this point and saving the seat for the repukes will require him not running again. Either way he is gone.

that anyone INDICTED had to step down. Remember, they changed it from under investigation to indicted. If they don't boot him now they have done the same thing about Delay that blivet** has done about Rove. More cronyism! The rules don't apply to them, they don't apply to the businesses that they contract with, they don't apply to their appointees ...

The poster must've been referring to Rush Limpdick, the famous chickenhawk and Bush butt-lackey who reportedly snorted so much Oxycontin, he lost both his (3rd) wife and his hearing.

Yep, Limp-dick is a more appropriate nickname for this bellicose right wing Rove-Co Butt Boy. :P

450. Might not be one.
DeLay's attorney, Dick DeGuerin, said he preferred a trial as soon as possible, at least by the end of the year. Asked when DeLay would turn himself in, DeGuerin said, "I'm going to keep from having Tom DeLay taken down in handcuffs, photographed and fingerprinted. That's uncalled for."

Uncalled for? Nonviolent people are handcuffed all the time.

505. McDougal was really given bad treatment!
McDougal was dressed in orange deathrow outfits when moved between prisons and was spat upon and urinated on by people thinking she was a murderer then. I think Delay should be made to endure the same treatment!! Probably doesn't need to be made to be a murderer to get that sort of treatment though.

513. Yes, that was deliberate.
What was done to Susan MacDougal was deliberate. I think it was a red jumpsuit. It was intended to connote child murderer, I believe. Her treatment was criminal, and for what?

I hope Tom DeLay is convicted. Not only is the channelling of donations against the law, it has a serious impact on the government. This is not a "light" crime.

I'm surprised that the sentence is only 6 months to 2 years and/or a $10,000 fine.

"Did you hear the news?" crooned the first one sweetly.

"YES, juust now!" I pumped my fist in the air as we passed, and they all cracked up and started hooting and hollering and talking at once. It was sweet. :) We NEEDED a ray of good news around here.

424. ELECTED Prosecutor.
I believe the term "ELECTED PROSECUTOR" or "DISTRICT ATTORNEY" is more appropriate. He serves the people of Travis County and the state of Texas, and has prosecuted more Democrats in cases like this than Republicans, despite his personal party affiliation.

Party identification is part of the Republicans' strategy to dodge the implications of corruption and change the subject.

The real issue here is not whether or not the charge is politically motivated (as the noise machine has just keyed into) but whether or not DeLay is guilty of the crime.

For the record, Tom DeLay's PAC has been accused and previously investigated for these crimes. Other cases, including the Valerie Plame scandal, political appointees to important administrative posts, and poor leadership in Iraq and across the board make it clear: The Republicans are entrenched in a culture of corruption and dishonesty.

148. It's a nice start.
Heat up that hot tub, Tom. It's not just a great way to "socialize" with the ladies. it's also helpful in calming the nerves as you sit there by your lonesome, contemplating the actions that have brought you to where you are today.

Good and decent Republicans would do well to start separating the wheat from the chaff in their party lest they all be blown away in the winds of corruption that plague that (long ago) once great party.

It will be painful for what is left of the uncorrupted Republican leadership to face up to what has happened in the White House where they have brazenly supported DeLay for so long. DeLay looks like a piker compared to what's gone on in the White House, and every day, more and more Americans see that. So join us, won't you? Help protect our country.

Enough is enough folks. The American people have taken all they can take of the filth.

184. BBC Breaking:Jury indicts top US congressman
The Republican majority leader in the US House of Representatives Tom DeLay has been indicted with criminal conspiracy by a grand jury in Texas. The charge relates to a campaign finance scheme in which two of Mr DeLay's associates also stand accused.

Mr DeLay, the second-highest ranking member of the house, said he would step down temporarily to answer the charges.

He is a key fundraiser for President Bush and is seen as yielding immense political influence.

http://rawstory.com/news/2005/Gay_Republican_eyed_to_become_House_0928.html

Gay Republican eyed to become House Majority Leader
John Byrne

AP is reporting that Rep. David Dreier (R-CA) is expected to at least temporarily succeed House Majority Leader Tom DeLay (R-TX) as majority leader, following DeLay's indictment.

RAW STORY revealed Dreier was gay and lived with his chief of staff last year. LA Weekly then outed him, and he promptly disappeared from the television news show circuit. Our story, which originally ran Sept. 20, 2004, follows in full.

#
A Republican congressman from California who has repeatedly voted against gay rights measures is said to be gay himself, and at least three MediaNews Group newspapers are said to have instructed its reporters not to ask questions about the congressman's sexuality or how it relates to public policy.

303. Is there a subculture of gay-bashing gays in power?
I mean, the Rove theories still fly, how Gannon never got more than disinvited from the annual Press Corps dinner is absurd, the head of the Repub party, Ken Mehlman, is gay, is this something that gets them off?

It doesn't have to be like the weird corss-dressing period gown scenes in JFK, but they gotta be having fun.

319. From Freeper Town
National Review Online ^ | 9/28/05 | Mark R. Levin
DELAY Here's my first take on this indictment (I've only read the indictment and nothing more for now): The indictment is three pages in length. Other than a statement that "one or more" of 3 individuals, including Tom DeLay, entered into an illegal conspiracy, I can't find a single sentence tying Tom DeLay to a crime. That is, there's not a single sentence tying DeLay to the contribution. The indictment describes the alleged conduct of two other individuals, but nothing about DeLay. You would think if Ronnie Earle had even a thin reed of testimony linking DeLay...

338. Yeah.. they're taking everything out of context
Here's the REAL context of what DeLay was involved in (it's in page 3-4)

"The Grand Jury further present that, with the advice and consent of counsel, the defendant, Thomas Dale DeLay, did heretefore knowingly, and volunarily waive the application of Articles 12.01 and 12.03 of the Texas Code of Criminal Procedure to the indictment present herein."

Basically he's circumventing the law on campaign finance reform. He's screwed fifty ways.

The only message this thing seems to be sending is if your one them crooks is you just have to be more careful. If the US had real congress of the people and was any kind of honorable institution they would have kicked this crook out long ago. One little victory does not win a war

celebrate the site would be 'experiencing high levels' of traffic.

The only thing that made me go hmmmm is that he's being indicted on only one count. There are just so many scams and schemes that I would think they could hang this guy on that one seems pretty negligible to me.

But believe me, this is great. I'll take any indictment and be happy about it.

4. Cheney
5. Frist
6. Rice
7. Wolfowitz
8. Hastert
9. Musgrave
10. Card

and for those not actually in the government:

1. Dobson
2. Robertson
3. Hannity
4. Limbaugh
5. Falwell
6. Savage
7. Hewitt
8. Bush Sr. (dried up old man, but I still want his ass taken down for Reagan's crimes)

387. Its amazing how the media try to paint it as political payback
and Delay being a victim. They dont seem to want to acknowledge Delays a crook and he broke the law flat out. The indictment clearly lays out what has been done and I have a feeling when these other two are found guilty we will hear a lot more about Delays involvement. Why else would he step down unless he knows theres more to come? One things for sure the Republican party has looked more and more like the bunch of corrupt idiots that they truly are as this year has progressed. I'm beginning to think the Democratic strategy of letting them hang themselves is working.

390. Agreed
In fact, the idea that it has taken this long to get even one indictment is unbelievable. The media is a big reason why. If it isn't about sex, they just don't seem to care. Oh, they'll cover a financial scandal for a little while, but it seems to be real hard to get them to stay on those types of scandals for any length of time. Never mind that republican financial scandals are faaaaaar more damaging to this country than rogue blow-jobs, etc.

This ass has been so obviously corrupt for so long that he should have been imprisoned years ago.

407. Scotty! My dear man? (flipping open comm device and adjusting settings)
ONE to beam down please?

Please recall that there is IMO little to NOTHING HONORABLE about this insecticide infested former bug killer. Don't you remember that "his clutch" of cronies almost CHANGED the *house rules* to accommodate this evil and smarmy republican leader we know as "The Hammer." :puke:

I would bet money there are a number of representatives IN his own party who are preparing to dance in the streets? As the "worm turns" Delay will not get the attention of the House Janitors much less anyone of importance within his own party. He's blackmailed far too many of "his own" to have not made some powerful enemies over the years.

The sharks are a-circling and some of the most vicious ones are Republicans who Delay has back-stabbed in the past.

You know what they say about payback?

And as my favorite pledge Flounder (from the flick "Animal House") would exclaim, THIS IS GOOD!

This indictment is just one of many shady deals orchestrated by Delay and other leading Republicans. There is a house of cards ready to fall related to Abramoff and his unethical activities involving a whole network of Republicans including both Delay and Rove.

Bush manages to show up in New York three days after 9/11, and these dimbulbs imagine it as the "bullhorn moment." Ridiculous. They take the necessary, and pretend it's some great virtue. Piddling little fuckers.

432. Only one person in the Clinton adminstration was ever indicted.

Since when is the government of China part of the Democratic party? And what do you mean by that crack about Chinese lobbyists not being Americans. You act as though it is somehow wrong that the Chinese lobbyists should be ... Chinese.

It is actually worse than you think. Did you know, for instance, that the Chinese ambassador to the United States is also a foreign national? I kid you not. He is Chinese too. Amazing. You would think that if they are going to employ people in the our country representing their interests they would have the decency to employ Americans.

At least you will be happy to know that the president of the China-American Business Chamber of Commerce is an American. His name is Bush, brother to the former US president and uncle of the current.

What a great day to join us in celebrating! Glad you're here!!!

Yes, I know, I know, it's just an indictment. A single indictment. And there's a lot more that still has to happen. He's down but not out yet. And I suppose he's got enough strings to pull that he might wriggle out of this. Even so, it'll still leave him as seriously damaged goods. That will always be on his resume. On his obit, it'll be there prominently, regardless what happens.

It's enough just to know he has this mark on his record now. That's what he was likely celebrating when the articles of impeachment went through against Clinton. So, how's it feel now, asshole? Have a little taste of it YOURSELF, then, 'eh?

Welcome to EVERYONE on here who's new or newly-posting. Great to have you here to share such an exhilarating day!

Wow - just added my recommendation - 58 now! That's a LOT!

436. Update from FreeRepublic.
Edited on Wed Sep-28-05 03:47 PM by DrCorday
The Wall St Journal reporter on CNBC this morning was right: "Republicans, right now, are in a fetal position." I just took a quick scan of the Freeper thread and panic was the clearest emotion. More recent posts are beginning to focus in on this "the indictment is political" spin. But it was fun to see the Freepers so hopeless for some good time there.

Be careful. Although Freepers seem hamstrung right now, and we're breaking out the champagne, we must remember: DeLay is a very smart, and very capable political operative. He will make every attempt to dodge, smear, and scam his way out of this. It is even possible he will succeed. The guy is totally wrong about every policy decision he's ever been a part of, he is very good at what he does. And what he does is playing politics.

Keep it on point: This is the latest chapter of the Republican's long history of a culture of corruption. It is clear they cannot be trusted with the important decisions that affect the fate and well-being of the American people. This is rapidly becoming more clear to the public, and it's time Republicans be held accountable and be made responsible for their ethical failures.

Finally, DeLay was indicted with something, that lying, corrupt-as-hell piece of fascist shit.

HOWEVER...

Do you ACTUALLY think he'll be convicted?

I SERIOUSLY, SERIOUSLY doubt he'll do ANY time.

He'll probably get the Medal of Freedom from Bush, who says he still considers DeLay to be a friend who has done great things for this country.

But just an indictment alone makes me pretty damn happy at this point. They should ALL be in PRISON getting the shit beat out of them, 24/7, for the REST OF THEIR FUCKING, FASCIST LIVES.

But at least DeLay is a start...

483. Could Things Really Be Changing?
I feel today is the day that I finally break out of lurk mode and make my first post. I have been following the discussions on DU for months now, absorbing all that I can. This has, of course, removed the blissful ignorance that most Americans live under. ("You can take the red pill, or you can take the blue pill...") I am all too aware now of just how corrupt, deceitful, divisive, greedy, and plain EVIL this administration is. Back in the day, I had hoped to pull the covers over my head when the SCOTUS "elected" Chimpy. Four years and he would be done. Then 9/11 happened/"happened", and the MSM made him a hero. Then came the Iraq invasion, (What, what, WHAT?!?!?) and the '04 "election". (There is no God.) There seemed to be no end. My girlfriend refuses to discuss politics with me because it depresses her so much. At times, the exploits of bush, cheney, rove, rice, rumsfeld, delay, frist, hastert, et al. were almost too much to bear. It was so obvious they were lying, cheating, stealing, etc. and GETTING AWAY WITH IT. But in light of recent events (and light is the appropriate term, exposing these bastards for what they are), I am allowing myself to have the luxury of hope. Luxury because the possibility of heartbreak is high, and the disappointment will be great. But I think, I hope, that things are changing. I really do. The bush administration has taken so much from us already, I will not allow them to take my hope. I will not.

537. karma - hope - pride - cockroach motels et. al.

i'll add my voice to the other 'lurkers' on this most bountiful of news days!! i understand those who plead for the celebrants here to remain level-headed...certainly is sound advice.

but for SO many of us, who on most days can no longer recognize the country we knew in our youth, who cannot stomach even the benign weather updates on the news broadcasts or even the living section of the daily papers due to the stench of rot that has fouled the entire media mechanism......we need a bit of a whoo-hoo. a soul-slap IS IN ORDER.

i live on the pacific coast, but just returned from a TX vacation and am taking particular pride in the fact that the state that SO MANY have vilified over the last number of years is the same state that has risen up and reclaimed the RIGHTEOUS HAMMER that hurtled through the late summer sunshine to deliver an ominous warning to the traitors.....and a much needed wind of restitution to so many of us on the sidelines of this seemingly lawless game.

it is better to be the hammer than the nail, indeed.
however the power of the hammer comes with commensurate duty of responsibility, honor, & righteousness. anyone foolish to lose sight of THAT truth whilst drunk with the 'hammer of the gods' only has to look into the lonely, vapid, & dejected eyes of Delay to begin to trace back through history all those who have forsaken the responsibility clause of the mighty hammer of power & influence.

a broken tool is worthless whether it is a shattered hammer or a flimsy, rusted, & bent nail..... such items bear no resemblance to the modest staples, tacks, glue, & primer who righteously answered the call to build something larger than the sum of the materials.

a weakness in our house has been exposed.
yet the house is stronger & more sturdy today because of it.

celebrate with a staple, dream of wielding the hammer, but remember GRATITUDE for our opportunity to take part in community first and foremost.

we're working on a building after all, a holy-ghost building--- do what is necessary to ready oneself for your role in it's construction.

....and if that involves photo shopping Delay with sadistic troopers, horny rhinos, or hard-worn drag queens.....so be it.

so many paths, so many patriots, ONE COMMON GOAL....

thanks to all you "regular DU" folk for all your energy & light which i can assure you have charged up my battries on numerous occassions.

peace, love, & revolution!!

workin' on a buildin'
workin' on a buildin'

The only sad thing here is that it wasn't a capital crime he was indicted for.

I'll take what I can get, but after all the evil this man has spread and all the harm he has done - there is no punishment that will be sufficient.

Let's hope the indictment turns into a conviction, and that the conviction turns into a jail term, and that the jail term finds good old Tom as the love slave to some of his fellow inmates.

499. WP: DeLay Must Appear in Austin on Charge
http://www.washingtonpost.com/wp-dyn/content/article/2005/09/28/AR2005092802128.html

AUSTIN, Texas -- The next step in the criminal proceedings against Republican leader Tom DeLay is a trip to Austin to be fingerprinted and photographed.

--snip

DeLay's attorneys were working out the details of when the 11-term congressman would return to Texas in hopes of saving him from further embarrassment, they said.

"What we're trying to avoid is Ronnie Earle having him taken down in handcuffs, and fingerprinted and photographed. That's uncalled for and I don't think that's going to happen," said Dick DeGuerin, DeLay's attorney.

Earle, the Travis County district attorney, said it is up to the court to decide how DeLay would be arraigned.

510. This makes me proud to be from Texas . I think that this "All hat and
no cows" carpetbagger from Connecticut is wearing thin on most Texans, especially after he so glaringly turned his back on the South and Texas during Katrina and Rita. That ole boy and his lackey Delay are finished.

The tougher they talk, the quicker they crawl!

DeLay took a big fall, and I doubt he's the last. I hope he gains some hubris from this event.

533. The media can all eat f'ing crow for beating up on Dean over this.
He said DeLay needed to go down to TX to serve out his sentence and they all criticized him for it.

Once again, Dean is right. Dean is ALWAYS right.

535. signs of the times...
W.B Yeats

Turning and turning in the widening gyre
The falcon cannot hear the falconer;
Things fall apart; the centre cannot hold;
Mere anarchy is loosed upon the world,
The blood-dimmed tide is loosed, and everywhere
The ceremony of innocence is drowned;
The best lack all conviction, while the worst
Are full of passionate intensity.
Surely some revelation is at hand;
Surely the Second Coming is at hand.
The Second Coming! Hardly are those words out
When a vast image out of Spritus Mundi
Troubles my sight: somewhere in the sands of the desert.

A shape with lion body and the head of a man,
A gaze blank and pitiless as the sun,
Is moving its slow thighs, while all about it
Reel shadows of the indignant desert birds.
The darkness drops again; but now I know
That twenty centuries of stony sleep
were vexed to nightmare by a rocking cradle,
And what rough beast, its hour come round at last,
Slouches towards Bethlehem to be born?

540. File a contempt of court for fox news
Edited on Thu Sep-29-05 06:01 AM by kalyanvenkat
Fox news's John Gibson says that attorney Earle conspired with the grand jury to have Tom Delay indicted. I can't believe that a mainstream press can say this in USA. In my mind fox has clearly crossed the line between freedom of speech and contempt of court. Also are there any laws in USA for contempt of court?
John Gibson's views are posted in the fox news website.

for the reasons you have mentioned.
