Judge Orders Release of Abu Ghraib Photos
Judge Orders Release of Abu Ghraib Photos By LARRY NEUMEISTER, Associated Press Writer
9 minutes ago (Thursday Sept. 29)

NEW YORK - Saying the United States "does not surrender to blackmail," a judge ruled Thursday that pictures of detainee abuse at Iraq's Abu Ghraib prison must be released over government claims that they could damage America's image.

U.S. District Judge Alvin K. Hellerstein ordered the release of certain pictures in a 50-page decision that said terrorists in Iraq and Afghanistan have proven they "do not need pretexts for their barbarism."

The ACLU has sought the release of 87 photographs and four videotapes taken at the prison as part of an October 2003 lawsuit demanding information on the treatment of detainees in U.S. custody and the transfer of prisoners to countries known to use torture. The ACLU contends that prisoner abuse is systemic.

The judge said: "Our nation does not surrender to blackmail, and fear of blackmail is not a legally sufficient argument to prevent us from performing a statutory command. Indeed, the freedoms that we champion are as important to our success in Iraq and Afghanistan as the guns and missiles with which our troops are armed."

1. "could damage America's image"
Gee, you bloodthirsty feaks, maybe you should have thought of that BEFORE you started torturing people!!! Jeez.

I'm so glad to hear this is released, but you know they will come up with yet another argument.

Regarding damaged reputations, * has damaged the reputation of the USA almost beyond repair. It will be years before we will be able to restore our reputation and that will only be if we get rid of the Republican administration.

19. National Security--and we can't tell you what or that would...
...undermine national security! I think they've already tried that though. But they'll come up with some garbage reason. They'll probably manufacture increased violence against our troops once these go public to say "see what happens?". And then the next atrocity will not get people so lathered to see the actual truth.

What do you suppose are in those photos? Pictures of Tom DeLay, Rove, and others performing the actual torture? If there is no sex involved, they still won't be impeach/fired.

37. You got it--the National Security card
I've heard that they are HORRIFIC, and involve way more than what we have seen thus far. Brutality beyond imagination...nothing that can be mocked by the right as Frat pranks that caused no permanent harm.

The release WILL shred our already tattered reputation, but hey, the truth will set us free in the long run.

Karen Huge is going to turn around this country's image in a New York minute. Just like Laura Bush took care of the country's gang related problems. What's that? Laura HASN'T taken care of our country's gang related problems? :wtf: How can that be? A Librarian is infinitely capable of tackling gang bangers, right? My gosh, you're not suggesting that we're.......being LIED TO? :wow: There's a possibility that Karen Huge ISN'T going to polish our tarnished image? OH NO! :cry:

details her and her daughters abuse at the hands of Bush, Senior and Cheney. Paul Bonaci won a million dollar settlement from Larry King, Bush Senior had Mr. King, who stole money meant for minority businesses and ran a pedophile ring that Daddy Bush used for blackmail. http://www.Raven1.net and ACHES sites for personal testimonies of those Americans and Canadians tortured in similar ways to what is going on at Gitmo, Belmarsh, Abu Ghraib.

image with everything else they have done....And like you said, shouldn't they have thought about "America's image and reputation" (not to mention morals, principles and our soldiers' and citizens safety in the world) BEFORE they went ahead and tortured people?

:grr:

With the Grand Jury indictments of Tom Delay and now this ruling, I still have some hope that Justice and the Constitutional Rule of Law will stop these corrupt cronies, torturers and fascist Neo-cons from their destruction of the United States.

insane by the torture at Britain's Belmarsh. I don't know if Gitmo is allowing letters or even the nationality of those who have been "detained" for more than 3 years. Yahoo had a story about an Australian who will be the first to go on "trial" military tribunal, no rights guaranteed, Yahoo news had a photo of his poor father looking terrible, angry at Australia for not defending their own and stating his disbelief that his son could get a fair trial.

WRITE TO THE FORGOTTEN DETAINEES (updated)Date: 07-Jan-2005

It takes little imagination to visualise life in a prison. The confined cell, the bare walls, the silence, and most of all, the feeling of isolation. Many have no family members in the UK and as a result they have become despondent and desperate. In one case, a detainee was actually seeking permission from a scholar to commit suicide until he began to receive letters from the public, which renewed his desire and motivation to live.

It is not enough that we feel sorry for what they are going through. It is not enough that we shed a few tears when we sit and think about what they are experiencing. Nor is it enough that we lay back and wait for others to take on the responsibility of reaching out to them. We must not fail them at this critical time. We must hasten to comfort them, and support them at a time when they need us most. We must write letters that give them hope, help strengthen them and motivate them to persevere in remaining patient. We must be their link to the outside world, a link that shows that they have not been forgotten.

Such letter-writing campaigns have proved to be hugely successful –with the 8 Belmarsh detainees receiving 60 letters each in the week that the campaign was first launched and with Babar Ahmad receiving over 50 letters in his first week in prison. Therefore we urge you all to make it a regular practice to write to at least one prisoner a week and to encourage all your family members and friends to do the same.

The letters can be as short as a paragraph, preferably written in your own handwriting as it is more personal, or if you do not have time to write a letter, you can buy a set of 'Thinking of You' cards. The content of the letters should be encouraging them to be patient, reminding them to have hope and that they have not been forgotten. This should not take more than half an hour and should not cost you more than £3. However, it may give hope to a prisoner for whom half an hour is like half a year.

For more information on why you should write and for ideas on what to write, click here. If you have included your name and address preferably a stamped addressed envelope) it is probable that the risoners will write back to you and you can find out exactly what heir situation is like inside. If you still prefer not to leave your ame and address, then please write to them anyway.

Please ensure that the prisoner addresses are written exactly as they appear below. PRISONER ADDRESSES UK HMP BELMARSH(Note: the detainees cannot receive books, tapes, clothes etc; money can help prisoners buying extra food and other items but should be sent via special delivery)There are more addresses on the cgeprisoners site

111. There are some new hideous photos out now
Americablog had some of them with some of the worse redacted and in the comments the site without the redaction.

"good questions. In the case of the Abu Ghraib scandal, it took one soldier who had refused to go along with what he saw, and handed over the evidence. It still comes down to the differences in the minds of certain people. Military or otherwise, there will always be some who can cross a line that others won't even go near.
~~~
These pictures sadly remind me of those disgusting lynching pictures popular in the US early last century, in which you had all of these white smiling faces around the burned out or hanged corpses of some poor African-American.
~~
As much as I hate to admit it, I think you may have a point. I can't think of any other explanation. It would also explain the high incidence of PTSD among Vietnam vets. I don't think it was just the fact that they were greeted with contempt (or apathy) when they
returned. I think it has something to do with how much better we've gotten at killing people.
War has always been hell. But technology has made it more hellish.
One wonders what nightmares will follow these soldiers home.o those (few) folks who like to blame ALL soldiers for the idiocy of a few... this is from Andrew Sullivan today...
McCAIN MOVES: The latest horrifying torture revelations give his proposed anti-torture legislation a push. This is a real war within Republicanism right now: the decency and honor of John McCain and Lindsey Graham versus the incompetence and brutality of Cheney and Rumsfeld. And in army captain Ian Fishback, we have a real American hero. In his words: "We are America. Our actions should be held to a
higher standard. I would rather die fighting than give up even the smallest part of the idea that is 'America.'" That's the real voice of the U.S. military. And it abhors the brutality this administration has sanctioned and covered up.
-- You know Democratic Underground has banned discussion of the Iraqi pics for web porn story.
Dunno if it is a word that came down from DLC or what but if more sites keep on repeating this story it is just going to incite people to stop supporting the troops. Not to mention that it just gives the enemy more propaganda.
---The average 70kg male has about 5.8L of blood in him. You can reasonably expect to pump 60% of that volume out before losing vital signs. So yes, there is that much blood.
Those soldiers are going to bring that attitude back with them. People will then be wondering why they shot their spouses, or are living on the street...---Was she following orders or wasn't she?
So many horrifying results from an unjustified war.Impeach and Indict.
We are liberating these people from what again? We are liberating these people from who and what again?
We call ourselves a "Liberating Force"? How about a "Killing, Raping, Torturing, Plundering, Force” It seems more appropriate and honest.
How could it get worse for the Iraqi people? What would/could be worse for the Iraqi people? How does this not make every single Muslim in the world not want to kill every single American they see?
If these were your family members what would be your next steps?
Please either write or call Congressman Conyers about this story. oh my best advice is to send the porn for pictures stories to ongressman john conyers of michigan. here is the other post:
http://www.democraticunderground.com/discuss/duboard.php?az=show_mesg&forum=104&topic_id=4924653&mesg_id=4924653
The judge uses Smirky's own words:
In its most recent discussion of FOIA, the Supreme Court commented that “FOIA is often explained as a means for citizens to know what ‘their Government is up to.’ The sentiment is far from a convenient formalism. It defines a structural necessity in a real democracy.” Favish, 541 U.S. at 171-72. As President Bush said, we fight to spread freedom so the freedoms of Americans will be made more secure. It is in compliance with these principles, enunciated by both the President and the highest court in the land, that I order the
government to produce the Darby photographs that I have determined are responsive and appropriately redacted.
The judge said: "Our nation does not surrender to blackmail, and fear of blackmail is not a legally sufficient argument to prevent us from performing a statutory command. Indeed, the freedoms that we champion are as important to our success in Iraq and Afghanistan as the guns and missiles with which our troops are armed."
Good or bad. The truth must be revealed.
America will have to deal with it. It sucks.
We need the truth.
82. This is a very profound statement...
and sums up what releasing these photos REALLY means:
The judge said: "Our nation does not surrender to blackmail, and fear of blackmail is not a legally sufficient argument to prevent us from performing a statutory command. Indeed, the freedoms that we champion are as important to our success in Iraq and Afghanistan as the guns and missiles with which our troops are armed."
To all you RW lurking idiots who think this will "damage our image" and "put our troops at risk", everyone in the world already knows that our government is condoning torture, much of the world already hates us, and, believe it or not, much of the world is nervously watching us as not only a superpower, but a fascist and possibly dictatorial superpower. What releasing these photos will show the world is that even the highest powers of our government are not above the law or the Geneva Convention and that democracy truly does win in the end -- and that's the most important message we could possibly send at this point.
52. US ordered to release more Iraq abuse photos
http://www.timesonline.co.uk/article/0,,7374-1803950,00.html
The United States is bracing itself for further criticism over the treatment of Iraqi detainees after a judge ordered the release of another batch of photographs of alleged abuse at Abu Ghraib prison.
The American Civil Liberties Union has sought the release of 87 photographs and four videotapes from Abu Ghraib as part of a lawsuit demanding information on the treatment of detainees in American custody.
The Pentagon has resisted the application, saying that the images would cause an intensification in the attacks against United States forces in Iraq and Afghanistan.
District Judge Alvin K. Hellerstein today dismissed these claims. He said that terrorists have proved that they no need "pretexts for their barbarism".
Several images of the abuse at the prison have already been widely distributed, but the lawsuit covers additional photos not yet seen by the public.
...more...
"Indeed, the freedoms that we champion are as important to our success in Iraq and Afghanistan as the guns and missiles with which our troops are armed."
General Richard Myers, the chairman of the joint chiefs of staff, argued against publication saying in court papers that releasing the photographs would aid al-Qaeda recruitment, weaken the Afghan and Iraqi governments and incite riots against American troops.
But Mr Hellerstein said: "My task is not to defer to our worst fears, but to interpret and apply the law.
The boys were sodomized with the cameras rolling. And the worst above all of that is the soundtrack of the boys shrieking that your government has. They are in total terror. It's going to come out."
The ruling was expected to be appealed, which could delay a release for months.
ACLU Executive Director Anthony Romero called it historic. "While no one wants to see what's on the photos or videos, they will play an essential role in holding our government leaders accountable for the torture that's happened on their watch," he said.
The U.S. attorney's office in Manhattan, which argued the case for the government, did not immediately comment.
Using a never ending appeal process would be just like the pentagon.
NEW YORK - A federal judge Thursday ordered the release of dozens more pictures of prisoners being abused at Abu Ghraib, rejecting government arguments that the images would provoke terrorists and incite violence against U.S. troops in Iraq.
ADVERTISEMENT
U.S. District Judge Alvin K. Hellerstein said that terrorists "do not need pretexts for their barbarism" and that suppressing the pictures would amount to submitting to blackmail.
106. BBC article: "Abu Ghraib images 'must appear' "
Last Updated: Friday, 30 September 2005, 07:05 GMT 08:05 UK
Abu Ghraib images 'must appear'
The images shocked the world (AP Photo/Courtesy of The New Yorker)
A judge in New York has ruled that pictures of Iraqi inmates abused by US troops should be released.
The judge made the order after a request by the American Civil Liberties Union for access to 87 unseen images.
District Judge Alvin Hellerstein rejected government arguments that this could fuel anti-US feelings.
(snip)
In a first reaction, the head of US Central Command, General John Abizaid, said publication of more pictures could distort reality.
"When we continue to pick at the wound and show the pictures over and over again it just creates the image - which is a false image - that this is the sort of stuff that's happening anew, and it's not," Gen Abizaid said.
(snip)
"Certainly I would be concerned but I would be equally concerned... that the pictures had not been released and you allow then any opposition to say 'but there is more'," Janis Karpinski told the BBC's Today programme.
