DeLay Court Appearance Set for Late October

AUSTIN, Texas (AP) - A Texas judge on Thursday ordered Republican Rep. Tom DeLay to appear in court next month to face the charge that he conspired to funnel corporate money to state political campaigns.

The summons calls for DeLay to appear in the court in Austin on Oct. 21, court officials said.

A grand jury indicted DeLay and reindicted two of his associates Wednesday in an investigation of a political fundraising group DeLay founded, Texans for a Republican Majority.

Prosecutors allege the group was used to channel corporate contributions to 2002 GOP legislative candidates. Texas law bans corporate contributions in political campaigns, except for administrative expenses.

3. his lawyers requested that he not be hancuffed, nor fingerprinted. etc.
DeLay's lawyers have said they do not want him to be handcuffed, photographed and fingerprinted when he appears in Austin.

Travis County District Attorney Ronnie Earle said it was up to the court to decide how DeLay would be arraigned.

DeLay also could waive going before a magistrate to have his rights and charges read to him.

His attorney wants to go to trial before year's end.

They said a trial judge had agreed not to issue an arrest warrant for Mr. DeLay and would let him appear voluntarily at a court hearing next month in Austin, the Texas capital.

The decision spared Mr. DeLay a potentially awkward encounter with the police in Travis County, where the indictment was issued, and the possibility that he might be handcuffed in front of cameras.

A lawyer for Mr. DeLay, Dick DeGuerin, said in a telephone interview that the decision by Judge Bob Perkins of the 331st Judicial Criminal District Court, a Democrat, was "the right thing to do."

The indictment does not charge that Mr. DeLay was personally involved in the transactions or in drawing up the list of candidates. Mr. DeLay said Thursday that he did not know about the transfer at the time. "I had nothing to do with day-to-day operations," he said of Texans for a Republican Majority. "I didn't know who they had targeted. I did not know where the money went." He insisted, however, that he was certain that all the transactions were legal and had been approved by the committee lawyers, adding that his associates were "instructed to check with lawyers on every decision."

The entire indictement is only about ONE transaction, with no specific detailed direct involvement that nails DeLay.

10. That's just wrong. Any other criminal would be cuffed and their
pictures taken along with prints etc. Why is it that white collar criminals get off so easy...that's such crap.

14. Yeah, that notoriously dangerous Cindy Sheehan gets cuffed for
sitting on a sidewalk and refusing to move. But gov't corruption on a significant scale, eh...let the poor fella voluntarily make an appt with us. Wouldn't want to embarass the guy by treating him like other accused criminal offenders....

Maybe he won't even have to go to court. Maybe they can just do email. After all, it wouldn't be seemly to have him sit in a courtroom while the prosecutor accuses him of bad things. The jury might be biased by the prosecution if they see DeLay at the defendant's table. :sarcasm:

That's a belly laugh on its face. Okay, so somebody besides Tom DeLay decided which Democratic congressman were going to be redistricted out of office? Give me a break.

At the time this was going on, everyone in Texas knew that Tom DeLay was orchestrating every move for TRMPAC. During the time of the Democratic legislators flight to Ardmore, Oklahoma, to avoid a quorum for a redistricting vote, DeLay was acknowledged as the godfather of the operation by the entire Texas media. He even had Homeland Security try to track them down and forceably take them to the statehouse in Austin for a vote. Everything to do with TRMPAC was a DeLay operation.

And his defense now is that he had nothing to do with it? That he didn't target the seats? Ohmygod, he's soooooooo guilty.

BTW, anyone remember that back in the day he was known as Tom DEElay (rhymes with relay as in race). Then one day he became "duhLAY". But through it all, from Texas to Washington, he remains, the one and only, "Hot Tub Tom".

16. Yelp, DeLay's real nickname is not "The Hammer" but "Hot Tub Tom" .....
here in Texas. DeLay got the nickname back in his J. R. Ewing boozing and women chasing days before he became a "Christian"
