NY Times reporter Judith Miller released from jail
By John Shiffman and Steve Goldstein
INQUIRER STAFF WRITERS

WASHINGTON - Judith Miller, The New York Times reporter who has been jailed since July 6 for refusing to identify a source, has been released, The Inquirer has learned.

Miller left an Alexandria, Va. jail late this afternoon, a jail official said.

She was released after she had a telephone conversation with the Vice President Dick Cheney's chief of staff, I. Lewis Libby, sources said. In that conversation, Libby reaffirmed that he had released Miller from a promise of confidentiality more than a year ago, sources said.

81. Please, she's already demonstrated the lengths she's willing to..
go in order to please her masters. She wont say dick, and even if she did it would probably be a lie. She's already established that she's willing to go to jail for this gang of thugs what's a little perjury to ensure their monetary support later on.
She's a bush whore and nothing will ever change that. I'm sure the Corporate Whore New York Times will take her back with open arms and she'll continue her propaganda campaign for the bushies.
This makes NO sense at all. She knew she had permission from Scooter to talk if she wanted, yet she refused. Now, after a phone call merely reaffirming that fact she's free to go? Something smells to high heaven here, I don't quite yet know what it is but after some serious thought I'm sure I or someone else will put the pieces together. Time to do some thinnin'!

131. Yes, Here it is!
quote......
After nearly three months behind bars, New York Times reporter Judith Miller was released Thursday after agreeing to testify in the investigation into the disclosure of the identity of a covert CIA officer.
"My source has now voluntarily and personally released me from my promise of confidentiality regarding our conversations," Miller said in a statement.

The Times, which supported her contention that her source should be protected, reported late Thursday that her source was Vice President Dick Cheney's chief of staff, I. Lewis "Scooter" Libby.

6. This whole business doesn't pass a smell test.
"Libby reaffirmed that he had released Miller from a promise of confidentiality more than a year ago"

She sat months in jailwaiting for Libby to reaffirm that she was released from confidentiality? If Libby had given that release way back when, then why wouldn't she ask for, and he give, the reaffirmation immediately instead of letting her sit in the slammer?

Blaaaap.
Blaaaap.

.....A spokesman for Fitzgerald did not immediately return phone calls.

Libby's lawyer, Joseph A. Tate of Philadelphia, declined to comment.

Since July, Miller had been held in suburban Virginia at the Alexandria Detention Center. According to The Washington Post, her visitors included former NBC anchor Tom Brokaw, U.N. ambassador John R. Bolton and former senator Robert J. Dole (R-Kan.).

203. Yeah, it is sort of interesting that the very day Bush
gets his own personal rigger installed as Chief Justice, Miller stops stalling. I'm too dumb to see how it directly helps the situation, but it's a nice insurance policy.

He (Bush) must be feeling pretty good about that. Even if hell froze over and Bush faced impeachment for some thing or another (torture, for instance) Roberts would preside over the Senate during the trial. Bush has Gonzales as AG, and now Roberts...

Both believe in Bush's virtually unchecked powers as CINC.

The journalists involved all said they felt the releases were obtained under duress, so to speak, and wouldn't honor them unless they got direct and specific release of confidentiality from their sources.

71. All the administration staff were forced to sign a release 1 year ago.
Both the Times reporter and Miller considered those releases given "under duress."

The only thing that has changed is her threshold for a release not given under duress. She held out longer than the pudgy, pasty Times reporter who folded under the pressure, prior to the slammer, thinking about life away from his lay-Z-boy.

if they didn't agree to the release it would be obstruction of justice. Whether she thought it was coerced or not doesn't make a damned bit of difference, it was a blanket release. The only reason she wouldn't talk is because of loyalty to the bush regime. She knew she had this a year ago yet chose to spend three months in jail protecting the slimeballs in the White House. There's a quid pro quo here somewhere, you can bet on it. What that happens to be is unknown at the moment but it will surface sooner or later.

Who says they won't all lie their ways out of this, just like every single other thing they've done.

I probably don't know enough to even say anything. I'm just blabbing my gut feeling. No fact to base it on.

I do know that Dan Rather and Martin Kalb were talking about making this a public issue. They were very upset that she was in jail. Especially having not published anything regarding Plame. I don't think they even get it. It's about crime. Not journalism.

Miller, but it seems the timing is maybe relevent.

He did say if he were a betting man he'd place money on an indictment.

42. Yup, I believe you're right...she has agreed
to testify otherwise she wouldn't be walking. The judge put her in there until the Grand Jury is done..only he can let her loose early if she decides to testify.
Big question is if she is going to commit perjury or tell the truth. Her testimony would have to match the details in a lot of other testimonies, not just one other persons.

167. Exactly right: there was scuttlebutt lately that jail was getting to her
she cajoled and pleaded, and probably the people at the ny times said you get libby to nod or we're pulling our support: they don't wanna be on the wrong side of a big administration indictment either. She's singing like a canary, probably as we speak, and Libby will be standing tall before the man in under a month. with any luck, cheney's gonna take a fall too, hence his ridiculous knee surgery publicity, warming up the crowd for the big smear.

judy's singing for sure, and she's had just enough of a taste of jail that she wouldn't dare perjure herself and land there for 6 more years. this is a catastrophe for bush, with any luck. the dirt is getting fucking deep.

35. So she is going to testify. I think Fitzgerald showed her lawyer a draft
of a complaint for criminal contempt. It would have been a slam dunk conviction and she could have recieved a two year sentence. She was willing to do a few weeks but not two more years. I hope Fitzgerald puts her in front of the grand jury right away. Based on parts of the written opinions of Judge Hogan and Judge Tatel in this case the indictments should start flowing pretty soon after that.

86. This could be the beginning off the end...
Let's see what we have so far. Bush was seven months into his second term. Things were not looking pretty. And now, in the eight month, we can add these little nuggets into the fray:

+ Delay, house majority leader - GOP. indicted, finished and not looking forward to his day in court.

+ Frist, senate majority leader - GOP. Being investigated, going downhill fast and his future isn't looking to bright either.

+ Abramoff, asshole and big time power broker - GOP. Indicted, radioactive and is probably going to jail for a loooong time.

+ Safavian, incompetent asshole and Whitehouse procurement honcho - GOP. Arrested, radioactive and is now looking forward to do some quality time with buddy Abramoff.

+ Franklin, neocon sucker and DoD spy - GOP. Made a plea with the feds and is going to jail.

+ Brown, fired FEMA director - GOP. Hemorrhaging political capital for * and ridiculed for giving incompetent people a bad name by just showing up.

+ Rove/Libby, gatekeepers for * and Cheney - GOP. If Miller squeals and these jokers get indicted, will set off the biggest political scandal since Watergate.

= GOP core meltdown and the lamest, most fucked-up president in the history of the United States. Probably drinking like a sponge by now...

Edited on Thu Sep-29-05 06:51 PM by Lone_Star_Dem
Don't you think he could have called and reminded her that she was sitting in the slammer for no reason?

There's more to this than what we see from the outside looking in.

It was reported last month that she was seeking a release from her source. We know it's not as if she just all of a sudden came up with the idea to give him a ring and see if he had previously released her.

Keep in mind that he did make her sit there for months, that could tend to make a person a bit angry.

so there's no point in Miller holding out. In other words, Libby is nailed (via other testimony, or maybe even his own admission), so might as well let Miller testify and get out of jail. That's seems like the most sensible read to me, at this point.

This is one event that doesn't require media coverage. Her testimony tomorrow is all that's required. After that the case should wrap up pretty quickly and then the indictments will be handed down.

NYT Reporter Leaves Jail After Agreeing to Testify
From Associated Press

5:39 PM PDT, September 29, 2005

After nearly three months in jail, New York Times reporter Judith Miller was released Thursday after agreeing to testify in the investigation into the disclosure of the identity of a covert CIA officer, two people familiar with the case said.

Miller left the federal detention center in Alexandria, Va., after reaching an agreement with Special Counsel Patrick Fitzgerald. Legal sources said she would appear before a grand jury investigation the case Friday morning. The sources spoke on condition of anonymity because of the secrecy of the grand jury proceedings.

117. Miller Agrees to Testify in CIA Leak Probe
WASHINGTON - After nearly three months behind bars, New York Times reporter Judith Miller was released from a federal prison Thursday after agreeing to testify in the investigation into the disclosure of the identity of a covert
CIA officer, two people familiar with the case said.

Miller left the federal detention center in Alexandria, Va., after reaching an agreement with Special Counsel Patrick Fitzgerald. Legal sources said she would appear before a grand jury investigating the case Friday morning. The sources spoke on condition of anonymity because of the secrecy of the grand jury proceedings.

The sources said Miller agreed to testify after securing an unconditional release from Vice President
Dick Cheney's chief of staff, I. Lewis "Scooter" Libby, to testify about any discussions they had involving CIA officer Valerie Plame.

Miller has been held at the federal detention facility since July 6. A federal judge ordered her jailed when she refused to testify before the grand jury investigating the alleged leak of CIA officer Plame's name by White House officials.

The disclosure of Plame's identity by syndicated columnist Robert Novak in July 2003 triggered an inquiry that has caused political damage to the Bush White House and could still result in criminal charges against government officials.

122. New York Times
Jailed Times Reporter Freed After Source Waives Confidentiality

By DAVID JOHNSTON
and DOUGLAS JEHL
Published: September 29, 2005

WASHINGTON, Sept. 29 - Judith Miller, the New York Times reporter who has been jailed since July 6 for refusing to testify in the C.I.A. leak case, was released from a Virginia detention center this afternoon after she and her lawyers reached an agreement with a federal prosecutor to testify before a grand jury investigating the matter, the paper's publisher and executive editor said.

Ms. Miller was freed after spending more than 12 weeks in jail.

Ms. Miller was freed after spending more than 12 weeks in jail, during which she refused to cooperate with the criminal inquiry. Her decision to testify came after she obtained what she described as a waiver offered "voluntarily and personally" by a source who said she was no longer bound by any pledge of confidentiality she had made to him. She said the source had made clear that he genuinely wanted her to testify.

That source was I. Lewis Libby, Vice President Dick Cheney's chief of staff, according to people who have been officially briefed on the case. Ms. Miller met with Mr. Libby on July 8, 2003, and talked with him by telephone later that week. Discussions between government officials and journalists that week have been a central focus of the investigation.

130. Hmmm. Scooter let her go, eh?
A little thinking out loud. Forgive my rambling--or enjoy this glimpse into a troubled mind.

The other night I joked that the Night of the Long Knives might be upon us, but I never suspected that the good guys might be the ones doing the stabbing.

With a nice thirteen-month lead time for damage control before the next Congressional elections, we have some of the most egregious offenders of the Republican leadership being knocked off by scandal, arrest, or indictment.

For the past month I've been ranting that Jack Abramoff is connected to the 9/11 terrorists, that the Bush Administration must have known in advance of the attacks, and that if the American public ever figured it out, it would be blood in the streets.

Maybe someone has orchestrated a graceful exit: start actually prosecuting certain offenders for the litany of lesser crimes in which they are all involved, while continuing to conceal that most dangerous revelation. Maybe they cut a deal.

Except for one thing: the War Wing of the executive branch has been notably unmolested--promoted, even. Cheney, Bolton, Wolfowitz, and Rumsfeld--the ones who philosophically asked for a "Pearl Harbor" attack back in 2000 as part of the PNAC, all seem to be doing just fine. All except Scooter, that is.

Not one of these pending cases will reach sentencing before 2007, just in time for the President to pardon them all.

I suppose the real question is: who will that President be?

The Times story indicates that Miller's lawyers started working on a new release from Libby in late August. (After Judy held out a couple of months) Its gone almost the whole way until October for a deal to be worked out? Libby must have really not wanted to give the release. Judy must have threatened to talk with or without it. Eventually a deal was worked out.

Folks like Judith Miller have no souls and will sell out their partners every time. No honor among thieves. It was only a matter of time.

But also, welcome to DU, and sorry for being mean. It's just that that woman's egrewgious reporting paved the way for the slaughter that is the Iraq war, and for that she should be up on charges, as are the radio talking heads who contributed to the genocide in Rwanda. She is directly culpable for tens of thousands of unnecessary deaths, and there's nothing honorable about that. So, it's not you I'm angry about, but rather Judith Miller, who sets me off every time. 181. I am disappointed - I have been emailing Cooper, Brian Williams and
sometimes Shepard Smith and Geraldo when I can find their email to report on the Blackwater mercenaries, the planned incineration of tons of food from UK, Spain, Italy and Israel, and the NOLA evacuees being sent around the country, some behind barbed wire or guarded behind fences not allowed to speak to the press.

Bush asked a number of governors to accept 10,000 evacuees each but only sent several hundred. The governors had to declare a State of Emergency to get aid which is a step away from Martial Law in which all laws are suspended. Thought bushco was trying to evade Fitzgerald indictments by illegally declaring Martial Law in NOLA then many other, if not all, stated.

I hope and pray that Fitzgerald can send the Federal Marshalls in after the entire bush regime and since Fitz can't indict POTUS but the Congress can Impeach = Indict. Rep. McKinney mentioned and may be called for Impeachment and as usual the mention of Impeachment was stricken from the Congressional Record. If she called for Impeachment and not just mentioned it, according to law, just one House member is necessary to start Impeachment.

Shamefully for the liberal blogosphere, Rep McKinney had to place her speech against the word impeachment being striken and the rest of the speech deals with the deliberate obstruction of aid to NOLA and the MK-ULTRA and Tuskee experiments related to evacuees behind barbed wire herself on Bellacio and at the bottom Rense.com.
I thought it took only one Representative to call for impeachment to get the ball rolling but if they censor the Congressional Record... Rep. McKinney should be invited to do article for DU or at least DU should do a story on this speech.

156. Here's what I think happened.......
Fitz made it clear that he would pursue criminal contempt, and that he would do so relentlessly. Obviously, she would absolutely be forced to testify because of this. So at that point, knowing that her testimony would eventually be given, Libby released her just to get the process moving.

In other words, why make her sit in jail for a few more months, when eventually, she would have to give in and testify, anyway? All it would do would be to postpone the inevitable for a few more months, and even Libby wants this case to go ahead and move forward.

On August 8 Conyers blogged about Libby waiver of confidientality

Miller to Testify on Friday

Just learned from the on-line edition of the Washington Post that Judith Miller was released from jail today in exchange for agreeing to testify before the grand jury tomorrow. Apparently, she called Libby and was able to confirm the he was releasing her from her pledge of confidentiality.

Amazingly, Libby's lawyers claim they are shocked, shocked, that their client's failure to provide a waiver of confidentiality had anything to do with Miller refusing to testify for three months, stating innocently "We are surprised to learn we had anything to do with her incarceration." I guess they don't read the conyersblog, because on August 8 I wrote to Mr. Libby pleading for such a waiver.

Anyway, here is to hoping that the testimony breaks Plame-gate wide open. Maybe this is part of the House and Senate GOP strategy of taking the heat off of Frist and Delay by changing the subject from insider trading and money laundering to treason?

224. Bolton is an original neocon, and that's behind everything. Period.
Bolton signed the famous 1997 letter to Clinton begging him to invade Iraw. Clinton just laughed at them. So, they cooked up Lewinskygate, and decided to steal middle eastern oil.

And that's behind all of it, because Wilson exposed the lies that gave the neocons cover for their occupation. This crime family is like all others: Defiance (Wilson) will be punished, and outing his wife risked her life and ended her power base. It was supposed to be a warning shot off her bow, to deter other defections.

Well, that strategy hasn't worked, and now the entire administration is going to be up on charges of treason.

This is impeachable, and that's why Miller didn't want to finger Libby: It opens them all up to treason, and they'll kill to prevent that. That's the only good reason someone would sit in jail for months for something someone else did.

Let's hope her testimony today fingered Cheney. It will be the beginning of the impeachment when it's made public.

Times Reporter Free From Jail; She Will Testify

By DAVID JOHNSTON and DOUGLAS JEHL
Published: September 30, 2005

(snip)

Ms. Miller was freed after spending more than 12 weeks in jail, during which she refused to cooperate with the inquiry. Her decision to testify was made after she had obtained what she described as a waiver offered "voluntarily and personally" by a source who said she was no longer bound by any pledge of confidentiality she had made to him. Ms. Miller said the source had made clear that he genuinely wanted her to testify.

That source was I. Lewis Libby, Vice President Dick Cheney's chief of staff, according to people who have been officially briefed on the case. Ms. Miller met with Mr. Libby on July 8, 2003, and talked with him by telephone later that week, they said.

(snip)

As part of the agreement, Mr. Bennett gave Mr. Fitzgerald edited versions of notes taken by Ms. Miller about her conversations with Mr. Libby.

In statements on Thursday, Ms. Miller and executives of The Times did not identify the source who had urged Ms. Miller to testify. Bill Keller, the executive editor, said Mr. Fitzgerald had assured Ms. Miller's lawyer that "he intended to limit his grand jury interrogation so that it would not implicate other sources of hers."

(snip)

The text said that the deal made with Miller's lawyers was based on not asking anything about other sources. This, and Libby's willingness for Miller to testify, tells me that the dirt she knows doesn't come from Libby, or else she is sure she and the Bush Administration are sure she can get away with perjury because her notes do not record the illegal parts of what was said.

There are also various statements on this development, linked to in the NY Times heading on the article. {Mods: the statements by individuals are not under copyright rules and thus the 4-paragraph rule, they are official disclosures.}

Statements by Sulzberger, Keller, and Miller on Her Release

Arthur Sulzberger, Jr.

By E&P Staff

Published: September 29, 2005 9:30 PM ET
NEW YORK The New York Times' publisher, editor, and formerly jailed reporter Judith Miller all issued statements Thursday night after her release, with Miller's grand jury testimony in the Plame probe now set for Friday, they confirmed.

A Times story late on Thursday revealed that as part of Miller's agreement, one of her attorneys, Robert Bennett, gave Patrick J. Fitzgerald, the federal prosecutor, edited versions of notes taken by Miller about her conversations with I. Lewis Libby.

According to the Times, Libby, Vice President Cheney's chief of staff, "had made clear that he genuinely wanted her to testify," and gave her an uncoerced waiver on their confidential conversations.

The Times story also revealed that Libby and his lawyers say he offered the waiver a year ago -- and then again ten days ago -- but Miller did not accept it. She was released today after she and her lawyers met at the jail with Fitzgerald to discuss her testimony, which will be severely limited, the Times revealed. A full E&P report can be found here (http://www.editorandpublisher.com/eandp/news/article_display.jsp?vnu_content_id=1001219261).

(snip - says any indictments in the Plame case may come "as early as next week.")

STATEMENTS FOLLOW:

***

Arthur O. Sulzberger, Jr., Publisher:

As we have throughout this ordeal, we continue to support Judy Miller in the decision she has made. Judy has been unwavering in her commitment to protect the confidentiality of her source. We are very pleased that she has finally received a direct and uncoerced waiver, both by phone and in writing, releasing her from any claim of confidentiality and enabling her to testify. We continue to believe that a strong Federal Shield Law must be passed by Congress, so that similar injustices, which the laws of both New York and Washington, D.C. already prevent, are not suffered by other journalists.

***

Judith Miller:

It's good to be free.

I went to jail to preserve the time-honored principle that a journalist must respect a promise not to reveal the identity of a confidential source. I chose to take the consequences -- 85 days in prison -- rather than violate that promise. The principle was more important to uphold than my personal freedom.

I am leaving jail today because my source has now voluntarily and personally released me from my promise of confidentiality regarding our conversations relating to the Wilson-Plame matter. My attorneys have also reached agreement with the Office of Special Counsel regarding the nature and scope of my testimony, which satisfies my obligation as a reporter to keep faith with my sources.

This enables me to appear before the Grand Jury tomorrow. I'll say nothing more until after my testimony. I do, however, want to thank The New York Times, and my husband, family and friends, for their unwavering support. I am also grateful to the many fellow journalists and citizens from the United States and around the world, who stood with me in fighting for the cause of the free flow of information. It was a source of strength through a difficult three months to know they understood what I did was to affirm one of my profession's highest principles.

***

Bill Keller, Executive Editor:

It's an enormous relief that Judy's ordeal is over. Her steadfastness in defense of principle has won her admiration from around the world, wherever people value a free, aggressive press.

Judy refused to testify in this case because she gave her professional word that she would keep her interview with her source confidential. At the outset, she had only a generic waiver of this obligation, and she believed she had ample reason to doubt it had been freely given. In recent days, several important things have changed that convinced Judy that she was released from her obligation.

Her friends and colleagues are delighted she's free, and -- if there is satisfaction in what she has endured -- I am satisfied that she has held fast to a principle that matters deeply.

The idea that Judith Miller is being allowed to set her lying self up as any kind of defender of freedom is beyond sickening. The blood of thousands of soldiers and civilians, dead in the Iraqi War that she played such a willing and ambitious role in promoting, are on her hands forever. She does not care, but we will never forget. We need to LTTE the NYT to object to this hypocritical pose, blatantly supported by the paper. There is no hint that they regret the thousands of deaths due in part to Miller's publications in their paper. And she STILL has her job. This is unnacceptable.

Re Miller testifying, if the Bush Administration thought she would spill the dirt, she would not be speaking. I don't see any way her testimony can be proven to be truthful - and we know from her Iraq stories that she's very comfortable with truly murderous lies if they advance her career. Plus, by the terms of her deal, no questions can be asked about her OTHER sources - if the traitorous leak came from one of them instead of Libby, she doesn't have to tell.

I'm betting it was Bolton. By the terms of her deal, she doesn't have to tell.

182. Oh My Gawd NWH I thought I was reading a satire piece

***
What The Fuck??????

Bill Keller, Executive Editor:

It's an enormous relief that Judy's ordeal is over. Her steadfastness in defense of principle has won her admiration from around the world, wherever people value a free, aggressive press.

Judy refused to testify in this case because she gave her professional word that she would keep her interview with her source confidential. At the outset, she had only a generic waiver of this obligation, and she believed she had ample reason to doubt it had been freely given. In recent days, several important things have changed that convinced Judy that she was released from her obligation.

It is absolutely not to be missed. The brief excerpt cannot do her justified outrage justice:

Arianna Huffington / Huffington Post / Sept 30, 2005

Miller Walks: The Plot Thickens

It’s time for Judy Miller and Arthur Sulzberger to change their talking points.

The claim that Miller “has finally received a direct and uncoerced waiver” is laughable… and, indeed, has already been laughed at by 1) my increasingly frustrated sources within the Times 2) a chorus of voices in the blogosphere (see here, here, and here) and 3) (and much more significantly) Joseph Tate, Scooter Libby’s lawyer, who told the Washington Post yesterday that he informed Miller’s attorney, Floyd Abrams, a year ago that Libby’s waiver “was voluntary and that Miller was free to testify”.

So it defies credulity for Miller, Sulzberger, and Bill Keller to keep insisting that Libby’s earlier waiver was coerced when Libby says that it wasn’t. I don’t have much good to say about the vice president’s chief of staff, but I don’t doubt that he knows the difference between being coerced and acting on his own free will. How deep is the Times’ contempt for its readers that they really think they’ll buy the “Oh, Judy finally has the right waiver” line?

The truth of the matter is there is no way that the New York Times editorial claiming “it should be clear…that Ms. Miller is not going to change her mind” can be squared with Ms. Miller changing her mind. And there is no way to accept at face value Miller’s grandstanding about “fighting for the cause of the free flow of information.” Who is she still trying to convince? Herself?

(snip - much more)

177. My two reasons for thinking this will NOT GET AT THE TRUTH:
1. There is no way to ensure that Miller's testimony does not include perjury about what was actually said in those Plame-related conversation(s). Her Iraq War work show she's perfectly comfortable with murderous lies, and the paper editors must be too because she still has her job after her criminal role in passing the Administration's lies in the leadup to the war.

2. According to the deal made with Fitzgerald's team and Miller's lawyers, she cannot be asked about any of her other sources. So if it was BOLTON who was the traitor who told her, or indeed if it was anyone but Libby, she DOES NOT HAVE TO TELL.

I'm betting it was Bolton who talked to her, and by the deal that has been made, she will not have to divulge this. This is JUSTICE???

183. CNN: Judith Miller-Cheney Chief of Staff Was Secret Source
Judith Miller-Cheney Chief of Staff Was Secret Source
Jailed reporter reaches deal in CIA leak probe

(CNN) -- After spending 12 weeks behind bars protecting a confidential source, New York Times reporter Judith Miller was released from jail after receiving permission from her source to provide evidence to a federal grand jury investigating the leak of a CIA operative's name.

<snip>

Lewis "Scooter" Libby, Vice President Dick Cheney's chief of staff, called Miller in prison September 19 to personally free her from the pledge of confidentiality, a move that apparently contributed to her release, Libby's attorney, Joseph Tate of Philadelphia, told CNN.

New York Times publisher Arthur Sulzberger Jr. said the newspaper supported Miller's decision to testify. "We are very pleased that she has finally received a direct and uncoerced waiver, by phone and in writing, releasing her from any claim of confidentiality and enabling her to testify," he said in a statement.

<snip>

The chain of events that led to the contempt charges against Miller began in July 2003, when syndicated columnist Robert Novak, who is also a CNN contributor, identified Plame as a CIA operative in his column. He cited unidentified senior administration sources for the information.

<snip>

"In recent days, several important things have changed that convinced Judy that she was released from her obligation," Keller said in a statement. He did not provide details of what those changes were. Miller said in her statement that she would not comment until after she testifies before the grand jury.

'Why didn't someone call us?' Tate said Libby signed a waiver of confidentiality more than a year ago, which Tate followed with a phone call to New York Times attorney Floyd Abrams assuring him that Libby's waiver was voluntary. Over the Labor Day weekend, Miller's attorney, Robert Bennett, tracked Tate down in Martha's Vineyard to tell him she had not accepted the waiver as valid because "it came from lawyers." "I assured Bennett that it was voluntary, and he asked, 'Would Scooter say that to Judy?' And I said, 'Scooter doesn't want to see Judy in jail,'" Tate said. "My reaction was, why didn't someone call us 80 days ago?" he said of his conversation with Bennett.

Looks like they figured they better have one person fall and hope that the rest don't get dragged down with him.

I'm sure that Judy has her "talking points" for the "official" story....

My hope is that Fitzgerald and the Grand Jury have much more evidence that goes much deeper than the Neo-con Bush/Cheney Cabal suspects and that all that Judy's testimony to the grand jury and the revealing as Scooter Libby as her "source" will just confirm what they know and help substantiate further the bigger truth behind the lies....

192. I would sketch it like this...
Libby takes the fall, because Rove or Cheney are the actual source and the White House Gang That Couldn't Shoot Straight cannot afford to have these 2 fall. Bolton/Miller connection is a red herring. Cheney's chief of staff is expendable because all he is really handling are Halliburtons no-bid contracts. Rove/Cheney are the "masterminds" behind the entire operation for Global Oil Domination (GOD), with it's unnecessary wars and Bolton is needed to buttfuck the UN into compliance. The Bolton/Miller link was most likely offered as a first attempt to distract because Bolton has managed to get the IAEA to do an Iraq on the Iranians. Libby isn't going to go to jail for too long as Bush is issuing pardons like they are going out of style. Also, Libby is going to receive a juicy bonus for being the fall guy, I bet.
Fitzgerald is hot on their heels and they are desperate to shut down his investigation, thus, Libby's "confession". Fitzgerald will probably be ordered to end the investigation in a week or two. But he won't because this Libby/Miller pact is a fake, just as it appears to be. Fitzgerald cannot miss the fact that Libby being offered up is a sign that there is blood in the water, and Fitz is the only one who could have bitten hard enough to spill it...so he knows he can't stop now.
Can anyone further my prognostications?

194. Spot on assessment my friend...I think that's a good sketch...I also think
that Fitzgerald has got more info than they realize and that Rove/Cheney are hedging their bets hoping he doesn't have more and hoping that offering the sacrifical lamb will help close things down. My hunch is that it will do no such thing and that Fitzgerald will actually be helped with this offering. I think that Novak and some other unknown sources sang....I think that Fitzgerald got info that even Rove/Cheney thought would stay secret....

196. RELATED THREAD on why Miller won’t give truth and Bolton is likely leaker
http://www.democraticunderground.com/discuss/duboard.php?az=view_all&address=104x4932994
thread title: Here are two reasons why I believe JUDITH MILLER WILL NOT GIVE THE TRUTH:

Please come join this discussion. There is documentation there to support the following arguments and scenarios:

First, the two reasons why Fitzgerald will NOT get the truth from Judith Miller:

1. She can lie and no one will be able to tell Her previous career in helping to foment the Iraq war based on lies shows she’s quite willing to do ANYTHING promote her career.

2. The specific agreement between the legal teams of Miller and Fitzgerald allows Fitzgerald to only see an EDITED COPY of Miller’s notes on the talk with Libby and – very important – prevents him from asking about WHO ELSE might have told her about Plame.

Second, I strongly suspect it was not Libby but BOLTON who was the leaker who spoke to Miller. Not only did he visit her in jail, but he was at the epicenter of the neocon group who blocked REAL intelligence on Iraq WMDs and substituted LIES to push the Iraq War. Seymour Hersh made that clear in his important “Stovepipe” article back in 2003. Remember that the most important aftermath of the Plame leak wasn’t the outing of Plame herself but the DESTRUCTION OF THE ENTIRE LONG-ESTABLISHED GROUP OF EXPERTS GATHERING REAL INTELLIGENCE ON MIDEAST WMDs. Bolton had a powerful motivation to do exactly that. He is insanely vengeful and can surely be imagined demanding that Wilson be punished, but more important, he would want the destruction of the conduits of information that contradicted the Administration’s lies on Iraqi WMDs.

Finally, Marie26 has come up with a plausible scenario that needs to be considered:

BOLTON told MILLER, and then MILLER told ROVE.

Remember how Rove claimed that he heard about the Plame leak from a reporter but couldn’t remember which reporter it was? (But it was not Novak.) What if the reporter in question was MILLER, who had been told by BOLTON? This would fit everything we know and would explain Bolton’s visit to Miller in jail. Rove would “forget” this because he would be protecting Bolton. And Bolton (possibly through his aides) would be a likely source for Miller’s printed lies in the leadup to the Iraq War.

Please come read more about the bases for these ideas and join the discussion:

209. Lying to a Grand Jury is not a good idea
If you thought refusing to testify in front of this Grand Jury was a "walk in the park", think again.

All of this is spin by Miller, The Times and her lawyers. More than likely J. Miller was advised by her lawyers that the special prosecutor, Fitzpatrick had informed them that the Grand Jury would be handing down indictments within the next 2 to 4 weeks and that if Miller did not testify by that time, they would also hand down an indictment for Miller charging her with obstruction of justice. If they could charge her with "Obstruction" then they damn well have the goods on all of them.

A good attorney, and Fitzpatrick is one, already knows the answers to the questions before he asks them. Don't forget that the job of the prosecutor and a Grand Jury is to not only make decisions on whether a crime or crimes have been committed, it is also to investigate those crimes, and it doesn't just mean gathering testimony from a small group of individuals related to those crimes. They have certainly subpoenaed mountains of documents and heard testimony from a multitude of sources who have not made the news.

Miller doesn't dare lie in front of a Grand Jury, and especially this one. Hence, the negotiation between J Miller's attorneys and the prosecutor Fitzpatrick on the scope and confines of the questions that will be asked.

The only information that has come out of this investigation by the Grand Jury, has been small bits and pieces from a few who have testified. Miller and her attorneys do not know what others have testified to, making it impossible for Miller to lie and risk perjuring herself. That too is a crime, and one I doubt Miller is willing to go to jail for.

And I hope she finds her ass back in jail again soon.

This final paragraph in an ABC News story says it more diplomatically:

"Starting in 2002, her stories about weapons of mass destruction in Iraq helped bolster the Bush administration's case for toppling Saddam Hussein. The failure to find the weapons prompted heavy criticism of Miller and the Times as well as of the Bush administration."

213. NYT reporter breaks silence in CIA probe case (Libby named!)
www.washingtonpost.com/wp-dyn/content/article/2005/09/30/AR2005093000488.html

This, after the WH had claimed for two years that neither Cheney nor Libby were involved..

Miller agreed to break her silence and testify after receiving what she described as a voluntary and personal waiver of confidentiality from her source, identified as Vice President Dick Cheney's chief of staff, Lewis Libby.

Lawyers close to the case said Miller's testimony appeared to clear the way for prosecutor Patrick Fitzgerald to wrap up his 2-year-old inquiry into who in the Bush administration leaked CIA operative Valerie Plame's identity and whether any laws were violated.

With Miller's testimony, lawyers said, Fitzgerald could move quickly to bring indictments in the case. Or he may conclude that no crime was committed and end his investigation and possibly issue a report on his findings.

216. Miller is in a world of hurt
remember she said she feared for her life when she went into the slammer.. Bolton and his pal Fietz (who was double dealing with both the CIA and with the Bolton's rogue intel unit) are ones that I'm pretty sure leaked to Miller, Libby was just following orders from Cheney..

This is going to get really stinky and complicated, that's why I spent the last month finishing up my Rove's War double set DVD.. it's 2 and a half hours of total info, a chronology, side trips such as the meeting in Rome with Leeden, Karl Rove’s foreign policy advisor and organizer of the meeting..

Nicolo Pollari, head of the the Italian equivalent of the CIA, the SISMI

Italy’s Minister of Defense, Antonio Martino (no relation apparently to the spy Rocco Martino), Pollari’s boss

Larry Franklin, an American who presently is being prosecuted in the US for giving classified information to an Israeli front group, AIPC (American Israel Public Affairs Committee) -- which some would call "spying," even though he has not been charged with espionage

Harold Rhode: member of Dick Cheney’s Office of Special Plans, protege of Ledeen, go-between with Iraqi exile and CIA asset (at the time) Ahmed Chalabi.

Ledeen already had a longstanding friendship with Francesco Pazienza, an Italian felon and forger...

Plus lots of soundbites from Comedy Central's daily show, fun graphics, ex CIA statements, Hearings, Downing Street Minutes Hearing which I filmed, lots of Wilson laying it all out - - and I wrote and performed a song for the end called "Secret Agent Plame" (like the old song "Secret Agent Man") for fun..

I plan to have it done over the weekend and start shipping - for all those who donated, I apologise for the delay, but I wanted to get it ALL in the film, and also have been to the emergency room twice this month, been really sick, but getting better..

especially with all this GREAT news!

Should be finished by over the weekend, then I'll fill the donations I received already and ask Skinner if I can fund raise (yeah, Takebackthemedia.com is running on fumes) here with my Rove's War Epic double DVD. It's good solid MEAT for political junkies that cuts through the confusion and fills in areas you never dreamed of, with no tin foil :)

225. I'm having a tough time with this
I see a lot of posts on this thread predicting this is another nail in the coffin for the Bush criminals. Others aren't so sure. I'm in the second camp.

Everything about this story is weird. Did Libby really release her to speak a year ago? If so, why did she go to jail? Is Libby lying (probably)? Is Miller (probably)? For what purpose?

Also, I'm skeptical Miller will do us any favors because of her reporting leading up to the war. She absolutely carried the administration's water for them. She was a huge Chalabi fan if I remember right. I personally put some of what happened in this war on her. She sacrificed all her journalistic integrity before the war, and I don't see why she'd act with integrity now.

There is a lot going on with Roberts, another vacancy, Frist, Delay, and Bush's abysmal ratings. That's why the timing of this worries me. Something stinks here. If she really was getting out ready to sing like a canary against the administration, I would be euphoric. But I've gotten my hopes up too many times in the last 4 years and I won't be fooled again. Plus, whenever there are strange coincidences with this administration, the stink of under-reported scandal soon follows. They are the masters of timing. They have made an art of burying newsworthy scandals under other political minutiae, and I sort of see that happening here. I hope Miller nails them and they all end up in jail, but I'm not betting on it.

226. Yeah, I hear you, but we got Delay and Frist is twisting in the wind
They don't own the judges, most of whom got their seats before the B** Cleptocracy.

What matters more than actual days behind bars is how smelly the GOP has become and how well dems do in the next 2 elections.

Imagine if your dems had all this filth all over them? How would you feel about your party right about now?

The smoke is almost worth more than the fire.

This has been a very good week. What have they got to pull them out of this nosedive? Terra doesn't work like it used to.

that the republicans are reeling right now...and I'm loving it. I'm just not looking for this Miller thing to help us.

233. Then why did Fitz need her so badly? Why did the judge jail her?
That draws so much attention to the whole gang, that you don't do that unless you really have to.

We all know the leak was Libby: But her sworn testimony is needed to write the indictments...You can't write indictments on "We all know that...." You need sworn testimony, and I think that's what Fitz got.

Libby's the sacrificial lamb.

228. You're right: she's a weasel
And worse than a weasel, as her hyperbole for the Bush administration helped lead the chant for war.

There's a reason over 70% of the American public salivated over invading Iraq. And little Judy Miller--chief cheerleader and willing dupe for the New York Times--is a significant part thereof.

234. That's total bull. She's a lying shill whore, and always will be. She

was so afraid of the B*** crime family, she hid in prison. For some reason, she feels safer, now. We'll find out why in the next weeks.

On edit, I wouldn't be surprised if what they told her is that they've finally found enough incriminating evidence to hang Libby, and so they told her they won't need to use her as a scapegoat. Someone decided who to finger, and so she could sing.
