Suit airs Able Danger claims
Two operatives in secret program say their lawyers were barred at hearings.

WASHINGTON - Two operatives at the center of the Able Danger controversy have sued the Defense Department for denying them contact with their lawyers during closed congressional hearings and other probes of the covert intelligence program.

Army Lt. Col. Anthony Shaffer and J.D. Smith were among a dozen intelligence officers and contractors who worked on the clandestine program set up long before the Sept. 11, 2001, terrorist attacks to track al-Qaida. They are accusing the Pentagon and two of its largest components - the Army and the Defense Intelligence Agency - of violating their First Amendment rights by blocking their access to legal counsel during the closed sessions.


The lawsuit, filed Monday with the U.S. District Court for the District of Columbia, marks the first time that the incendiary claims at the center of the Able Danger saga have been made in court.
"Able Danger identified the Sept. 11, 2001, attack leader Mohamed Atta, and three of the 9/11 plot's 19 hijackers, as possible members of an al-Qaida cell linked to the 1993 World Trade Center attack or its participants," the suit said.

1. And I bet some of the transcripts that Sybil Edmonds
translated and her co-workers were erasing could verify that data. I hope she is able to come forth soon. I read on DU that they even made the 60 minutes program that she was on inaccessible to the public. Those shitheads are hiding something...can we say LITHOP?

Able Danger (search) is the code name for a military-intelligence unit that apparently learned a year before the Sept. 11, 2001, terror attacks that lead hijacker Mohamed Atta (search) and other terrorists were already in the United States.

One of the central Able Danger claims — that military lawyers blocked the sharing of the Atta information from the FBI in the late summer and early fall of 2000 — will be a focus of the committee's if a hearing takes place, FOX News has confirmed.

Some analysts involved with Able Danger have recently gone public with their findings, saying they were discouraged from looking further into Atta, and their attempts to share their information with the FBI were thwarted, because Atta was a legal foreign visitor at the time.

"This story needs to be told. The American people need to be told what could have been done to prevent 3,000 people from losing their lives," said Rep. Curt Weldon (search), R-Pa.

Weldon drew attention to Able Danger by speaking about it on the House floor and publicly calling for the Sept. 11 commission to explain why the intelligence information wasn't detailed in its final report.

Some Able Danger analysts, including Army Reserve Lt. Col. Anthony Shaffer (search) and Navy Capt. Scott Phillpott (search), claim that in October 2003, they told commission staffers of the presence of Al Qaeda operatives in the United States in 2000.

I don’t know the answer to that question because I know my side of the story, I know that when a 2 star general got in my face and said, “I’m a 2 star general and you are not. You are to stop your support of Able Danger.” That’s what I know personally. But the question has to be: Who told him to do that? ...

WASHINGTON (Reuters) - Three more people associated with a secret U.S. military intelligence team have asserted that the program identified September 11 ringleader Mohammed Atta as an Al Qaeda suspect inside the United States more than a year before the 2001 attacks, the Pentagon said on Thursday.

The Pentagon said a three-week review had turned up no documents to back up the assertion, but did not rule out that such documents relating to the classified operation had been destroyed.

Navy Capt. Scott Phillpott and Army Lt. Col. Anthony Shaffer last month came forward with statements that a secret intelligence program code-named "Able Danger" had identified Atta, the lead hijacker in the attacks that killed 3,000 people, in early 2000. Pennsylvania Republican Rep. Curt Weldon (news, bio, voting record), vice chairman of the House of Representatives Armed Services Committee, also went public with the allegations.

Pat Downs, a senior policy analyst in the office of the undersecretary of defense for intelligence, told reporters that as part of the review, the Pentagon interviewed 80 people.

Downs said that three more people, as well as Phillpott and Shaffer, recalled the existence of an intelligence chart identifying Atta by name. Four of the five recalled a photo of Atta accompanying the chart, Downs said.

Pentagon officials declined to identify the three by name, but said they were an analyst with the military's Special Operations Command, an analyst with the Land Information Warfare Assessment Center and a contractor who supported the center.

Downs said all five were considered "credible people."

But officials said an exhaustive search of tens of thousands of documents and electronic files related to Able Danger failed to find the chart or other documents corroborating the identification of Atta. Phillpott has said Atta was identified by Able Danger by January or February of 2000.

"We have not discovered that chart," Downs said.

The first government witness is expected to take the stand
Monday afternoon. Six federal agents on tap to testify for the

Administration - are expected to be defense witnesses,
according to court records.

The defense argues that the FBI and other government agencies
knew more about the hijackers' plans than Moussaoui knew and
still failed to stop the attacks.

Moussaoui will either receive life in prison or the death penalty depending on
whether the jury finds he was aware of the Sept. 11 plot with enough specificity
to have warned US officials of the plan when he was arrested in
August of 2001, thus preventing the terror attacks. Moussaoui's defense lawyers
have attempted to compel the testimony of US Rep. Curt Weldon R-PA
who was recently subpoenaed as a witness to the extent of the government's knowledge
of the identities of Sept. 11 hijackers before the terror attacks.

Weldon does not want his testimony to potentially aid the defense of an admitted
terrorist, and has claimed official immunity from a subpoena. :puke:

So the responsibility for stopping DIA program Able Danger, which had Identified Atta and 3 other hijackers and linked them to 56 other al-Queda terrorists overseas, has been laid at the feet of Bill Clinton--except he and Richard Clarke were never told about it at all.

That's right. Bill Clinton was never told about Able Danger and the ID of Atta because Richard Clarke was never told about AD. How do I know? He never wrote about it in his book, nor did he testify about it's existence before the 9-11 Commission!

You see Richard Clarke was known for being obsessed with Osama Bin Laden and HE was the guy the neo-con moles did not want to find out about Atta and the gang. Schoomaker and the neo-cons knew telling the FBI would inform Clarke and then Mr. Laser Beam himself, President of the United State William Jefferson Clinton, would have gotten involved--and the Pearl Harbor-type attack would never take place (the neo-cons talked about the need for a Pearl Harbor-type attack before the PNAC Plan would be accepted by the American people--so when one presented itself, they let it happen).

General Pete Schoomaker, who were later heavily rewarded by the neo-cons in the Bush Administration, blocked the upward motion of the DIA information by having Shaffer and Philpott meet with Pentagon lawyers opinions--lawyers who were rubberstamping ridiculous legal opinions to carry out the neo-con plan. These certain people were neo-cons in the Clinton Administration, covertly carrying out the PNAC plan to let a Pearl Harbor-type attack occur so Iraq and 6 other countries could be invaded.

Three more assert Pentagon knew of 9/11 ringleader By Will Dunham

WASHINGTON (Reuters) - Three more people associated with a secret U.S. military intelligence team have asserted that the program identified September 11 ringleader Mohammed Atta as an Al Qaeda suspect inside the United States more than a year before the 2001 attacks, the Pentagon said on Thursday.

The Pentagon said a three-week review had turned up no documents to back up the assertion, but did not rule out that such documents relating to the classified operation had been destroyed.

Navy Capt. Scott Phillpott and Army Lt. Col. Anthony Shaffer last month came forward with statements that a secret intelligence program code-named "Able Danger" had identified Atta, the lead hijacker in the attacks that killed 3,000 people, in early 2000. Pennsylvania Republican Rep. Curt Weldon (news, bio, voting record), vice chairman of the House of Representatives Armed Services Committee, also went public with the allegations.

Pat Downs, a senior policy analyst in the office of the undersecretary of defense for intelligence, told reporters that as part of the review, the Pentagon interviewed 80 people.

Downs said that three more people, as well as Phillpott and Shaffer, recalled the existence of an intelligence chart identifying Atta by name. Four of the five recalled a photo of Atta accompanying the chart, Downs said.

Pentagon officials declined to identify the three by name, but said they were an analyst with the military's Special Operations Command, an analyst with the Land Information Warfare Assessment Center and a contractor who supported the center.

Downs said all five were considered "credible people."

But officials said an exhaustive search of tens of thousands of documents and electronic files related to Able Danger failed to find the chart or other documents corroborating the identification of Atta. Phillpott has said Atta was identified by Able Danger by January or February of 2000.

"We have not discovered that chart," Downs said.

``Please don't make him a hero. He doesn't deserve it.''

FBI agents have been forced to admit under cross-examination that
the FBI knew years before Sept. 11 that al-Qaida had plans to use
planes as missiles to destroy prominent buildings.

The blow-by-blow recitation Tuesday by prosecutor David Raskin of the
hijackings _ a stipulation of facts agreed to by both sides _ did
nothing to link Moussaoui to the plot, but nonetheless provided an emotional wallop.

FBI also had to acknowledge numerous missed opportunities in the months before Sept. 11
to catch two of the hijackers with terror links known to the government, even though the
pair frequently used their own names in this country to rent cars, purchase
plane tickets and even, once, to file a police report after getting mugged.

"This is the second significant error by the government affecting
the constitutional rights of this defendant and more importantly
the integrity of the criminal justice system of the United States
in the context of a death case," Brinkema told lawyers outside
the presence of the jury.

"In all the years I've been on the bench, I have never seen such
an egregious violation of a rule on witnesses," she said.

The defense motion to eliminate the death penalty, if accepted,
would end the trial and result in a life sentence with no chance
of parole for Moussaoui. The defense did not move for a mistrial,
which would have restarted the proceedings.

Get this....Prosecutors, seeking to distance themselves from Martin's actions, castigated
her as a ''lone miscreant'' and said she acted ''essentially as outside counsel'' in
coaching the witnesses.

But Moussaoui's defense lawyers, in legal papers filed Thursday, said Martin
had worked closely with prosecutors.

"The government attempts to minimize Ms. Martin's involvement in this case,
reducing her to virtually the status of a messenger," they told the judge.

"It is worth noting that Ms. Martin, at least, has worked on the
prosecutorial team itself, as well as with the aviation witnesses."

The government has alleged, but Moussaoui has not conceded, that
Moussaoui's lies to the FBI when he was arrested in August 2001 caused
(and were intended to cause) more deaths on 11 September 2001 that
would have been prevented had Moussaoui confessed to the FBI and fully
informed on his co-conspirators. Under current Federal law, Moussaoui can only
be executed if the government can prove this to the judge beyond
reasonable doubt.

That's the purpose of the current "sentencing trial". It's an
evidentiary, fact-finding hearing, before a Federal judge, under the Federal rules
of criminal procedure and evidence, on essentially the sole question of
whether the measures the FAA claims they would have taken in the name
of "aviation security" if they had gotten Moussaoui's full confession in
August 2001 -- and which are among essentially the same measures the
FAA and its successor the TSA actually have taken since 11 September 2001
would actually have helped prevent the September 11th attacks or saved
any lives if they had been done sooner.

That's what panicked Ms. Martin into into illegally coaching the
witnesses from her agency and its predecessor: the prospect of a fair hearing and
a judicial verdict on the likely efficacy for safety, security, and
reduction of loss of life to terrorism of her agency's so-called
"security" measures. According to news reports, she told the witnesses
in her e-mail messages that she feared the judge might find that
Moussaoui's lies didn't lead to any deaths, since the things the FAA would have
done if they had known more about the attackers' plans wouldn't have
prevented them.

Presumably she knew she might be caught violating the witness
sequestration order. If she was (as, indeed, she has been), the result
would be that the "death notice" would be dismissed, and Moussaoui
would live out his life in prison. But she took that risk anyway, a decision
that makes sense only if she was more eager to avoid a verdict that the
FAA and TSA tactics wouldn't have made us any more secure than she was
eager to avoid having the death notice dismissed and Mousaoui live.
The real worst-case scenario for Martin, which she and and the TSA
apparently have now succeeded in averting, was a judicial verdict that
as the TSA's own advisory committee, Congressional auditors from the
GAO, and every independent airline security expert I've ever spoken with
have have already concluded -- the TSA has failed to make a case for its
airline passenger surveillance measures as being justified on grounds
of safety, security, prevention of terrorism, or saving of lives.

Which, of course, brings us to the real question below the surface of
this case: If these aren't really measures that will make us safer, why is
the TSA compelling things like the conversion of airline reservations and
operational systems into an infrastructure of surveillance ? It's hard
to avoid the conclusion that surveillance, not security, is the real goal
that justifies -- at least to some three-letter agencies of the
government -- the dollar expense (billions) and political cost of these programs.

no time litigating cases, according to people familiar with her work.

When prosecutors wanted an aviation-related document declassified
in the Moussaoui case, they turned to Martin. Her role was sharply
defined: She was to locate the proper bureaucrat, who would then
approach an agency such as the CIA. It was up to that agency to
decide whether the document could be introduced in open court.
