Fastow, already sentenced to 10 years in prison on two counts of conspiracy in the 2001 collapse of the energy giant, was set to take the stand Tuesday as a key prosecution witness.
The government was expected to portray Fastow as a critical pillar in its quest to prove Lay and Skilling lied to Wall Street and their own employees to conceal the crumbling finances that drove Enron into bankruptcy.
The 44-year-old ex-CFO is central to the defense case as well: Lawyers for Lay and Skilling say there was no overarching fraud at Enron, and that it fell victim in part to Fastow's stealing money from the company. Skilling, the former CEO, and company founder Lay are charged with fraud and conspiracy, among other crimes, in the spectacular collapse of Enron in 2001. The defense claims there was no massive fraud at the energy-trading giant.
