RICHMOND, Texas - Rep. Tom DeLay is fighting to regain his concealed handgun permit after it was suspended because of his indictment on felony charges.

A justice of the peace suspended DeLay’s license in January after the former majority leader was indicted last year. A judge dismissed a conspiracy charge, but DeLay still faces a felony charge of money laundering.

Under state law, the Texas Department of Public Safety can suspend a handgun license if its holder has been charged with certain misdemeanors or higher.

Steve Moninger, an attorney for the Department of Public Safety, which administers the handgun licensing law, said the state will contest the appeal.

“We are going to keep going. Our function is to enforce the statute,” Moninger said.

Incorrect. A convicted felon cannot so much as touch a gun or a single round of ammunition, and cannot even "constructively possess" a gun. If Delay's wife owns a gun, she'll have to keep it in a safe that he does not have the combination to, and providing him the combination would be a felony, as I understand the BATFE interpretation of the Gun Control Act of 1968.

That's not entirely correct. The BATFE Form 4473 (purchase record) must by law be retained by the gun dealer for 20 years, and the dealer must also make a permanent record of the transaction in his bound book. If the gun dealer goes out of business before those 20 years are up, she/he must transfer the Form 4473's and the bound book to the Bureau of Alcohol, Tobacco, and Firearms.

The background check data contains no information about the gun transaction, just the fact that a check was run through NCIS. The check record must be cleared within a set time (I thought 24 hours, but it may be 5 days) if the person passed the check. Records of failed checks are kept forever.

You are correct that there is no central registry of gun ownership in Texas, but there is indeed a permanent record of gun purchases from gun dealers.

if you don't buy the gun at a gun show (in Texas, that is). So when the locals all go to the gun show (at the George R. Brown Convention Center, or such), they can buy any gun they can afford with no background check, and no delays of any sort (yup, that's right... not even a check for felonies... I think they have to sign an affadavit that they don't have any felonies, but do you really think that'll stop a crook?).

All sales at a gun show by a gun dealer must involve the mandatory NICS point-of-sale background check and BATFE Form 4473, and the seller must retain the form 4473 for 20 years. That's Federal law. The majority of gun-show sales fall into that category.

Texas does not require background checks for private sales (some of which do occur at gun shows), but that has nothing to do with whether or not the transaction takes place at a gun show. And of course engaging in the business of selling firearms without a Federal dealer license is a Federal felony.

Yes, he can continue to own guns until convicted. At that point, he would become prohibited from so much as touching a gun, or a single round of ammunition, for the rest of his life, with no possibility of appeal unless W pardons him, or the conviction is overturned. That's Federal law (the Gun Control Act of 1968).
