Breaking: Rove Meeting With Special Prosecutor About Leak Case


John King, CNN’s political correspondent, just reported:

CNN is told by three force sources familiar with the investigation that this morning Karl Rove, the president’s deputy chief of staff and top political adviser, is meeting with his attorney and is to meet this morning — if it is not already under way — with the special prosecutor, Patrick Fitzgerald. According to sources, the goal of the meeting is for Karl to clear up some lingering questions about his role in a White House campaign to undermine Ambassador Joe Wilson — remember he was the the critic of the Bush administration case ever going to war in Iraq, his wife the CIA operative Valerie Plame, whose name was Outed.

It’s a complicated legal investigation and it has become a complicated political problem for the White House. Our understanding, Karl Rove is meeting with his attorney this morning, meeting with the special prosecutor this morning and the hope from Rove’s camp is that he can answer the few remaining questions about his involvement, his back and forth with reporters, during that time frame, his comments to the FBI and other investigators including the grand jury that is investigating this for quite some time now. And the hope from the Rove camp, all can be resolved and Karl Rove cleared of wrongdoing in the relatively near future.

The AP is also reporting that Fitzgerald went before the the grand jury this morning.

Guess who went back before the Grand Jury this morning, according to the AP? Yep, it’s our boy Fitz.

Special counsel Patrick Fitzgerald early Wednesday went before a federal grand jury looking into the leak of the identity of undercover CIA officer Valerie Plame….

Fitzgerald’s unfinished business includes White House deputy chief of staff Karl Rove, who was under investigation when the previous grand jury that indicted Libby expired.

Rove’s legal problems stem from the fact that it was not until more than a year into Fitzgerald’s criminal investigation that the White House adviser told the prosecutor about disclosing the CIA status of Wilson’s wife to Time magazine reporter Matt Cooper on July 11, 2003.

Rove says he had forgotten the Cooper conversation, which occurred several days before Plame’s identity was revealed in Novak’s column.

Rove and Novak also had discussed the CIA status of Wilson’s wife.

Other unfinished business in the probe focuses on the source who provided Washington Post reporter Bob Woodward information about Plame, whose CIA identity was leaked to Novak in July 2003.

Hmmmmmm…and when you add in a report this morning from CNN’s John King that Karl Rove and his attorney(s) met with Fitz this morning in person, the mind begins to whir, doesn’t it?

I’ll be working the phones as I can today, and no doubt Jane will do the same. More news as we get it folks. It may be cold outside here today, but I think things may be heating up. Here’s hoping…

UPDATE #2: Norah O’Donnell reports on MSNBC that Rove will be testifying today before the G/J for a fifth time in the CIA leak case. I have to say that in my experience, this is really unprecedented — I can’t ever remember any witness who was also potentially a subject in an investigation giving a prosecutor this many under oath opportunities to skewer them. O’Donnell reports that there are serious questions about how forthcoming/honest Rove has been — and that there are potential questions of more legal jeopardy. May be expecting a statement from Rove’s legal representatives some time this afternoon, according to O’Donnell.

about himself. It also seems implausible that Karl's assistance was really needed to locate and understanding missing e-mail, considering that Fitz has had access to the backup server tapes since September 30, 2003.

Further, Fitz indicated in a letter to the court a couple months ago that he is interested in the July 7 INR, and related documents, as well in its chain of custody that reportedly includes Marc Grossman (State), Libby (OVP and OOTP), Rice (State), Fleischer (WHPO), and others.

So, Karl and Fitz have had a lot to talk about, and it isn't just about Rove.

They see the raw you-better-believe-it's-prejudicial evidence that defense lawyers get excluded. Rove's good fortune is that this isn't the same group of people who have been listening to him lie for years. And, yes, you can bloody well tell when someone is lying under oath. They get tics. Twitches. Their voices choke. Then the prosecutor asks a question that can be answered truthfully and their bodies and voices relax. the relief is so palpable at being able to be truthful that the lie stands out in neon colors.

The negative for Rove is that the grand jury is really it for him. White collar criminals do NOT want a public trial with a jury of their peers. Because it won't be. It will be pissed off poultry judging the fox. So he's making whatever deal he can to avoid that.

WASHINGTON - Top White House aide Karl Rove prepared to testify Wednesday for a fifth time before the federal grand jury investigating the leak of a CIA officer's identity, a person familiar with the case said.


Rove consulted with his private lawyers before a scheduled afternoon court appearance and was prepared to answer questions about evidence that emerged since his last grand jury appearance last fall, the person said, speaking only on condition of anonymity because of grand jury secrecy rules.

That new evidence includes information that emerged late last year that Rove's attorney had conversations with Time magazine reporter Viveca Novak during a critical time in the case.

Special Prosecutor Patrick Fitzgerald met with the grand jury Wednesday. Among other things he is investigating why Rove originally failed to disclose to prosecutors that he had talked to Time magazine reporter Matt Cooper about the outed CIA operative,
Valerie Plame, back in 2003.

Five times in front of a grand jury?! Even if a guy is completely innocent of wrongdoing (which almost certainly does not describe Rove), an attorney would be remiss to let his client appear that many times in front of a grand jury. Each and every time in front of a grand jury the chance of the client contradicting or, worse, perjuring his or herself rises exponentially. So yeah, I would think it is safe to say that Rove is talking about more than just himself.

Karl Rove's appearance before a grand jury in the CIA leak case Wednesday comes on the heels of a "target letter" sent to his attorney recently by Special Prosecutor Patrick Fitzgerald, signaling that the Deputy White House Chief of Staff may face imminent indictment, sources that are knowledgeable about the probe said Wednesday.

It's unclear when Fitzgerald sent the target letter to Rove's attorney, Robert Luskin. Sources close to the two-year-old leak investigation said when Rove's attorney received the letter Rove volunteered to appear before the grand jury for an unprecedented fifth time to explain why he did not previously disclose conversations he had with the media about covert CIA operative Valerie Plame and her husband, former Ambassador Joseph Wilson, who criticized the Bush administration's use of pre-war Iraq intelligence.

A federal grand jury target letter is sent to a person in a criminal investigation who is likely to be indicted. A "target" of a grand jury investigation is a person who a prosecutor has substantial evidence to link to a crime.

Last week, Rove was stripped of some of his policy duties in a White House shakeup orchestrated by incoming Chief of Staff Joshua Bolten. The White House insisted that Rove was not demoted, but insiders said the executive branch is bracing for a possible indictment against Rove.
