High court may hear Cheney appeal
WASHINGTON -- The Bush administration's sustained campaign to build up the powers of the presidency and to extend the confidentiality of White House decision-making is due for a major test in the Supreme Court, possibly as early as today.

<snip>
The key argument is that the Constitution's separation of powers among the three branches means that the other two branches are without authority to second-guess the president when he and his staff are deciding how to use executive powers.

The position of the administration in the case parallels arguments against judicial interference in the president's handling of the war on terrorism, arguments being made with increasing frequency in court cases involving terrorist suspects or "enemy combatants."

The White House has been making similar arguments in a running battle over access to internal presidential papers that are being sought by the National Commission on Terrorist Attacks Upon the US, an independent body that is investigating the Sept. 11, 2001, attacks.

...US v. Nixon to give Cheney the relief he seeks?

United States v. Nixon, 418 U.S. 683 (1974):

"Neither the doctrine of separation of powers,
nor the need for confidentiality can sustain an absolute,
unqualified Presidential privilege of immunity from judicial process."

2. The SC is corrupt and will probably hear this case.
I don't think we will wait in suspense for the outcome. The neocon fascist takeover is being enabled by a corrupt judiciary. When the revolution comes, they will be punished.

9. Top Classified Secret!
The identity of actual doers should not be disclosed, since it will severely damage our national security!

The same in the case of exposed CIA agents.

6. Judicial Watch already has a map of Iraq oil reserves from the
meeting. Why is this fact not disclosed in the article? The map is available on-line at Judicial Watch. We need to make these papers our number one issue IMO.

8. Why so many typos?
Come on people. Not spelling a word correctly makes the boards look like they're populated with morons. For everyone's sake, please be careful when you post.

11. DU'ers are not disrespected due to abilitiy/skill levels
Edited on Mon Dec-01-03 03:10 PM by Angel_O_Peace
Some people will always have problems with choosing the correct word for use, correct use of noun/verb agreement, or misspeling words over and over again. What's important is the participation and getting one's message across. Writing and/or typing abilities are not always an indicator of one's level of intelligence or insight.

Woo-Hoo! My 1,000th post!

13. Looks like the fix is in.
The Imperial High Court, also known as the Judicial Arm of the Coup, will vote to allow Vice-Imperial papers remain secret.

It's a 100% certainty. Like Hitler's, Saddam's, Mussharraf's "election" victories.

Man, I long for the unpredictable days of freedom.

But Totalitarianism is as predictable as can be.

100%.

Cheney wins.

But they will have their specatacle and illusion of a trial. The Imperial Subects of Amerika do love to fancy that they rule themselves...

15. I agree it will probably happen BUT they will open themselves up
to a lot of ridicule. They are still smarting from the dissenting opinion in Bush v Gore that the real loser of the case was respect for the Supreme Court and the rule of law.

Not only that, but if they block 9-11 investigations, they will show the world that they are willing to sell out not only the Presidency (i.e., democracy) but national security (i.e., treason).

16. Correct me if I'm wrong
but isn't Cheney arguing the same thing Clinton did? Back then Repukes were all up in arms about "Whitehouse secrecy," etc. Funny how the argument changes when they're in power... :eyes:
