California Highway Patrol officials have opened a criminal investigation into "multiple" breaches and illegal downloads by outside hackers into the computers of Gov. Arnold Schwarzenegger's office, after an embarrassing private taped conversation was leaked last week to the Los Angeles Times, administration officials told The Chronicle.

"There is an investigation conducted by the California Highway Patrol on how the tape obtained by the L.A. Times was acquired," said a senior official who spoke on condition of anonymity. "This is a criminal matter that has been turned over to the CHP."

The governor was criticized last week after the Times reported that during a conversation in March with Susan Kennedy, his chief of staff, and Gary Delsohn, his speechwriter, Schwarzenegger referred to Latinos and African Americans -- specifically Republican Assemblywoman Bonnie Garcia, who is of Puerto Rican descent -- as having "hot" blood or a passionate temperament.

The Times reported that the conversation had been taped as part of Delsohn's occasional practice to capture the governor's speech patterns for his work....

15. They weren't hacked as much as they were entered without authorization

At issue was a computer system that allowed Republican staffers to read Democratic memos and correspondence without a password. Some of these staffers argued that they told the Democrats about the security breach in the summer of 2002. Others believe mum was the word before November 2003. In any case, the Republicans had more than a year of unfettered access to Democratic documents before this scandal became public.

Each time the Republicans accessed the Democrats' files without authorization, they at a minimum violated the federal Computer Fraud and Abuse Act, 18 USC Sec.1030(a)(2). That statute includes anyone who "intentionally accesses a computer without authorization or exceeds authorized access, and thereby obtains 3; information from any department or agency of the United States."

The Bush cabal doesn't do investigations, don't you know?

8. In California, the Highway Patrol and the State Police merged

about a decade ago. So, functions that would be covered by the SP in other states (such as dignitary protection and security at the Capitol and other state building) are done by the CHP. The reason for the merger was an attempt to streamline agencies and cut costs a bit...

reporter's source for the story. The CHP investigates and finds out who had access (internally) and busts them for sharing the information and like a miracle, the hacker angle gets completely forgotten about. I wonder......
