CHICAGO -- Prosecutors said Friday that former Gov. George Ryan should not remain free on bond while appealing his racketeering conviction but instead should start his 6½-year prison sentence as scheduled Jan. 4.
Prosecutors said U.S. District Judge Rebecca R. Pallmeyer's decisions during the seven-month trial of Ryan and co-defendant Larry Warner were basically sound and therefore were likely to be upheld by appeals judges.
"At bottom, this court made careful credibility findings that will be accorded great deference on appeal," prosecutors said in 24 pages of court papers urging Pallmeyer not to grant Ryan an appeal bond.
Whether Ryan gets to remain free on bond or must report to prison Jan. 4 as planned is likely to depend on whether judges believe his appeal stands a good chance of winning a new trial.
