Justices Defend Florida Recount Decision (Scalia - Get Over It)

Three of the five Supreme Court justices who handed the presidency to George W. Bush in 2000 say they had no choice but to intervene in the Florida recount.

Comments from Justice Anthony Kennedy and retired Justice Sandra Day O'Connor are in a new book that was published this week. Justice Antonin Scalia made his remarks Tuesday at Iona College in New York.

Scalia, answering questions after a speech, also said that critics of the 5-4 ruling in Bush v. Gore need to move on six years after the electoral drama of December 2000, when it seemed the whole nation hung by a chad awaiting the outcome of the presidential election.

"It's water over the deck - get over it," Scalia said, drawing laughs from his audience. His remarks were reported in the Gannett Co. (GCI)'s Journal-News.

11. How do you make a decision and declare no precedence?
How can you make a ruling and say it is one-case-only? Isn't precedence the check on judicial review -that you have to consider the scope of the decision??

I'm not a lawyer but that is something that even they can't reconcile.

15. The cases I saw in which it happened before were peculiar circumstances
that were unlikely to happen ever again.

The current junta can not use that rationale because it is very likely we will have more close elections in the future. So Bush v. Gore is totally FUBAR and corrupt on its face.

There is no defense for this decision. These so called "justices" had neither the constitutional authority nor any legal precedent to support their decision. They willfully violated the law. Period. End of story.

Any honest legal analyst will tell you that.

How can two justices rule on a case in which their own families stood to benefit financially?

I have no idea why pundits far and near did not blast Scalia and Thomas for corruption, why Jeb Bush isn't blasted as part of a corrupt machine to install his brother, why Republican staffers who started riots during the vote count were not prosecuted (the images have circulated and the names are known).

More than one article has dealt with the ethical issues involved. Here's a link to one.

Your tenure on the court will be discussed in depth by future legal scholars, and they will say things about you far more insulting than I can.
