Senate votes to end Gonzales' power to name prosecutors

WASHINGTON — The Senate voted overwhelmingly Tuesday to end the Bush administration's ability to unilaterally fill U.S. attorney vacancies as a backlash to Attorney General Alberto Gonzales' firing of eight federal prosecutors.

Amid calls from lawmakers in both parties to resign, Gonzales got a morale boost with an early-morning call from President Bush, their first conversation since a week ago, when the president said he was unhappy with how the Justice Department handled the firings.

With a 94-2 vote, the Senate passed a bill that canceled a Justice Department-authored provision in the Patriot Act that had allowed the attorney general to appoint U.S. attorneys without Senate confirmation. Democrats say the Bush administration abused that authority when it fired the eight prosecutors and proposed replacing some with White House loyalists.

"If you politicize the prosecutors, you politicize everybody in the whole chain of law enforcement," said Judiciary Committee Chairman Patrick Leahy, D-Vt.

What they like about him is his "Wake up and smell the coffee" stance on the war, and his direct language.

But you are quite right, he's not just right, he's far right.

Who knows, perhaps he's ANGLING for CHENEY's job, after he resigns due to "illness." That would make him the putative incumbent.

It may not be the best analogy, but there are similarities: during the '00 campaign, and for a few years afterward, McCain was the "maverick Republican" that Democrats & lefties looked to as a "sensible, Centrist" politico who, at least by appearances, was somewhat of a thorn in the Bush administration's side. He was often the guy Dems would name when they were asked a question like "Which Republican/conservative/etc. do you like/respect/etc. the most?"

Most of us know that whatever shred of independence McCain once had--and I do believe at some point he was more centrist and flexible than he is now, though not to the degree some of us believed--is long-gone. A shame. Several years ago, I foolishly thought that McCain may become for the Democrats what Zell Miller eventually became for the Republicans, only without the psychotic behavior and excess spittle. Who knows, maybe Shrub & Co. secretly kidnapped McCain's poodle during the 2004 convention and threatened to torture it if he didn't come around.

Hagel isn't quite the political obfuscator that McCain was, perhaps because Chuck is a tad more simple, or whatever--that is, he doesn't bother hiding his true right-wing credentials the way McCain did. But he does like to come off as something of a maverick, as the proverbial thorn in Bush's side, though methinks he's actually about as thorny as a Care Bear.

I imagine the votes for this bill in the House are going to be similar. It only takes a 2/3 vote of both houses to override a Presidential veto, so we can shove this one down Bush's throat!

38. it's been awhile, but wasn't there something about Hagel?
he has interest in one of the voting machine companies--there was questions about his win (over the top win against his Democratic challenger). Apparently, the numbers didn't add up and the challenger went in front of the Senate Ethics Committee. It's been awhile, but didn't someone on the ethics committee step down because of the allegations of voter tampering?

a couple of days ago when they signaled that they had no objection to the passage of this. And he won't pull the signing statement shit either. The WH just wants this whole USA mess to disappear. They won't do anything to exacerbate it.

53. Well, given that throwdown today, he does have something to hide.
You don't fight like a dog if it's no big deal, and claiming "executive privlege" over a personnel matter suggests this is a personnel matter that became a political matter that became a personnel-political matter that bled over into law enforcement and prosecution (or non-prosecution) of criminals for personal and political advantage.

That whole "Will Rove and Harriet testify?" matter, separate, but related, is gonna be interesting. David Bois seems to think that the courts won't rule in BushCo's favor. Some flak from the National Review (Ryan Lizza) is agreeing with him. I'm watching that asswipe Scarborough, BTW.

I certainly wish I could be so sanguine. That said, I DID sense that Bush was having his finger-wagging "Ah did not have sex with those US Attorneys, ah never told anyone to LIE, evah...." moment.

And we know what happened after that. Governance became difficult, if not impossible.

49. Why does this article call what the Senate did "backlash"?
And in the first sentence, no less?

The Senate voted overwhelmingly Tuesday to end the Bush administration's ability to unilaterally fill U.S. attorney vacancies as a backlash to Attorney General Alberto Gonzales' firing of eight federal prosecutors.

They are merely taking back a historical power they've always had and never should have lost. Sure, they are angry but this is a much more fundamental issue than "backlash."

50. They've corrected one great wrong in the "Patriot Act", go after the others too!
Imagine, giving away the power to approve appointments involving such vital offices? They better have fixed this--but look what it took to get them going? The whole lot of them who voted for the thing in the first place should be ashamed of themselves.
