Republican Janklow faces sentencing
http://www.cnn.com/2004/LAW/01/22/janklow.sentencing.ap/

SIOUX FALLS, South Dakota (AP) -- It started last summer when a man who witnessed a Cadillac collide with a motorcycle said he talked to then-Rep. Bill Janklow at the scene.

The next morning, the Highway Patrol confirmed that the former governor and state attorney general was driving the car and had been injured. The rider of the Harley-Davidson, 55-year-old Randy Scott, was killed instantly.

Now, five months after the August 16 crash, the 64-year-old Janklow is scheduled to be sentenced Thursday in his boyhood hometown of Flandreau. His resignation from Congress took effect Tuesday.

Janklow was convicted December 8 of second-degree manslaughter, speeding and running a stop sign, and reckless driving.

1. I pray that
my occasional inattention does not lead to something tragic.

But this guys was bomb waiting to explode and lots of people (including the cops) knew it - his defense was nonexistent - have a nice time in the slammer!

2. What time?
I thought he was supposed to be sentenced at 1:00 mountain time but I'm not sure. Also, does anyone know where the first breaking news on his sentence might be posted? I was thinking yahoo.com might have the first reports on his sentence.

7. Sentence
FLANDREAU - Former Congressman Bill Janklow will spend 100 days in the Minnehaha County Jail for his role in the death of a Minnesota motorcyclist in August but will not have to spend time in the South Dakota State Penitentiary.

After 30 days he will be allowed to be released to do public service work. He is also on probation for 3 years during which he will be unable to drive.

After he serves that time, he will have the felony removed from his record, a procedure known as a suspended imposition of sentence.

12. 100 days is a travesty!
The man arrested on Animal Precinct for dropping a dog out of an apartment window (and killing it) got more time than that!

9. I'm surprised he even got that
Most people that I talked to locally assumed it would be a "token" weekend in jail.

13. Actually 30 days in jail, no prison time.
Is this normal for 2nd degree manslaughter? Sounds like the judge may have "bought" the diabetes defence. Well, at least he won't be driving (legally) anymore.

11. 100 days, out walking around in 30? Total bullshit.

Hope the civil suit bleeds him dry.

Some Dem candidate needs to point out how cheap life is to these assclowns.

14. What's even more disgusting is if the law enforcement and
judicial systems there had done their jobs, he wouldn't have been driving long ago.

15. To report to jail Feb 7th
Former South Dakota Congressman Bill Janklow will serve 100 days in jail, pay a fine and lose his driving privileges for three years while he's on probation for a fatal accident. But Judge Rodney Steele suspended a prison sentence against the former congressman and governor for a manslaughter conviction that killed motorcyclist Randy Scott. If Janklow abides by the conditions and obeys the law, his record will be cleared. After 30 days, Janklow will be allowed to leave the jail six days a week for up to ten hours a day to do community service. Judge Steele also fined Janklow five-thousand dollars and ordered him to repay Moody County 50 dollars a day for the cost of his 100 days in jail. Janklow was ordered to report to the Minnehaha County jail in Sioux Falls on February seventh to begin his sentence.

18. Now this is what I would call "Tough on Crime" as the GOP likes
to proclaim they are. If that had been Tommy Chong, Lord have mercy what they would have wanted done to him.

100 days for killing a human being.

"Steele gave Janklow a suspended imposition of sentence, which means he will not go to prison."

You know if this Janklow was a regular Joe he'd have been sent up the prison for 10 yrs. Instead because of his connections and money he essentially walks free. What an outrage. If I were the family of Randy Scott, I would make sure that Judge Steele was removed. They should sue in a civil court for wrongful death. They won't see justice any other way. How disgusting.
