Judge Rodney Steele has handed down a sentence for former Congressman Bill Janklow. Janklow has been sentenced to 100 days in the Minnehaha County Detention Center. After 30 days, he will be allowed to finish that time by doing community service.
Judge Steele also fined Janklow $5,000 and repay Moody County $50 a day for the cost of his 100 days in jail. Janklow was ordered to report to the Minnehaha County jail in Sioux Falls on February seventh to begin his sentence.

they get good time and work time in county jail. I don't know what it is in his state, but generally they automatically get 30-50% off the actual days sentenced for these credits. So when he is off doing community service he gets credits towards his work time.

The fact of the matter is that here in the Heartland a very, very large percentage of people "habitually speed." No, that doesn't make it right. And no, that doesn't mean we shouldn't be held responsible for our conduct.

But under a properly functioning criminal justice system, it's the conduct, not the outcome, that should form the primary basis for assessing the punishment. It's referred to as the element of "blameworthiness."

Let's take a different example -- assume a no name nobody is driving to the store, becomes distracted, and blows through an intersection. Has it ever happened to you? It sure as hell has to me -- and I consider myself to be a safe driver. Now, let's assume that our hypothetical normally safe driver is unlucky: He plows into someone killing them. Is he really more blameworthy than you or me? Don't get me wrong: Consequences do come into play and what would have been a traffic ticket now becomes a serious crime. But in assessing the punishment for that crime it's primarily the act itself that should be weighed. Civil trials are to compensate injured people (such as the heirs of the victim in Janklow's case). Criminal trials are primarily to punish the conduct.

Is 100 days too little in this case given his history? Probably. But this business of it should have been 10 years or even 100 years is also wrong. Part of being a liberal to me means opposing the idea that lengthy imprisonment should be imposed just to make people feel good. And yes, it's a disgrace that minor drug charges bring much longer sentences, but the remedy there is to change the law, not to extend the stupidity to other situations.

Such a sad, sad story. When I was young I used to ride bikes. I was hit by cars twice, over the years. After the second time, I quit riding.
Suffice to say being hit by a car running a stop sign is a real bitch. I flew up in the air cartwheeling head over heels and the impact actually knocked my shoes right off my feet (just like in the cartoons). When the ambulance arrived they just scooped me up off the asphalt and scooted me off to the emergancy room. One year later I was good as new.
The guy who blew the stop sign...sent me flowers.
