Concord MonitorJustices find no cause to protest sale of data The Supreme Court yesterday unanimously dismissed an attempt by the New Hampshire Republican Party to force Democrats to reimburse the state for money made from selling voter data. The GOP, the court ruled, suffered no harm and "lacks standing" to bring the case.
"So far as we can discern, the (Republican Party) argues that it has suffered injury because the (Democrats) made money by selling the lists and it did not, thereby placing it at a disadvantage," Justice Richard Galway wrote in a decision signed onto by the four other judges. He added: "Even presuming the (Democratic Party) was unjustly enriched, it was not at the expense of the (Republicans)."
The Republican Party appeal didn't have much in common with the original case, Libertarian Party vs. Secretary of State. That case successfully challenged a state law that allowed only the two major parties to purchase a detailed voter file from the state, with data including name, party registration history and age, for about $500. Previously, such data could only be collected on a town-by-town basis.

Democratic Party Chairman Ray Buckley painted Republicans as the ones who were wasting taxpayer money.
"Not only did the Supreme Court rule that the GOP did not suffer any legal harm or disadvantage, but they also concluded that the Republican Party had no standing to bring the complaint forward," Buckley said in a statement. "This is yet another example of the New Hampshire Republican Party clogging the court system with frivolous and baseless complaints. While many New Hampshire residents continue to struggle in the current economic climate, the Republican Party has wasted taxpayer dollars on a non-issue."
