Holder's View Is Worrisome to Mukasey

WASHINGTON -- Attorney General Michael Mukasey raised concerns that government agents and national security lawyers may be at risk for criminal prosecution after his likely successor, Eric Holder, declared that waterboarding of terror detainees is torture.

The 67-year-old former federal judge in New York, who took office 14 months ago, said in an interview that the incoming administration of President-elect Barack Obama faces a "conundrum" as it tries to shut down the prison at Guantanamo Bay, Cuba.

Word that Mr. Obama plans to issue an executive order to close the prison has caused worry among Justice Department lawyers who fear evidence backing the cases against many of the approximately 250 detainees wouldn't hold up in a conventional court proceeding.

Mr. Holder made the torture comment at his confirmation hearing Thursday when asked about the technique, which induces the sensation of drowning and was used by Central Intelligence Agency interrogators on at least three detainees.

12. Not everyone agrees with his curious interpretation of criminal law...
He stated, I believe at an ABA meeting, last year that violating the law isn't necessarily a criminal act. His verson of Kay Bailey Hutchison's "technicality." As in Democrats commit crimes, Republicans commit technicalities. I foam at the mouth at the mention of Kay Bailey Hutchison. And at the thought that Democrats in Texas voted for her in 2006. Women in Texas apparently believe she is "one of them." Texas truly is a scary place.

As for anyone being prosecuted, I doubt it. It would be nice. It's just I know Washington. And it won't happen.

21. This is obtuse thinking. The wrong was in the initial
opinions. Let us not compound the error by not saying what it was (criminal). I understand that saying it was wrong opens up that door of uncertainty in the future, and that is the reality created by this administration's actions, unfortunately. By refusing to call it what it was now, we would be perpetuating the error into the future in that we would be setting a precedence that says "anything the administration's lawyers say is fact that cannot be challenged later," giving all future administrations an unchecked balance to subvert the rule of law via their lawyers opinions. It is clear you can find a lawyer somewhere to support any foolish (in this case criminal) opinion. Mukasey's stance is serious flawed. The correct approach is to punish those who violated the constitution and then set up a system in which future lawyers cannot subvert law through biased/errant opinions, thus solving the initial crime and adverting the problems that Mukasey suggests.

34. Tough luck. Anybody with a soul knows that torture is wrong. I have zero sympathy
and I hope that everybody involved in torturing people is prosecuted to the fullest extent of U.S. and international law. That includes the guys at the very top.

This is not about criminalizing a policy dispute Treaties that the US signed prohibit torture.

Mukasey is in the position of a bad cop who beat a confession out of a suspect and then claims that its criminalizing a policy dispute when it has been expressly forbidden to beat confessions out of people for 15 years and every literate person can look the law up.

I am opposed to the death penalty in all cases except the prosecution of war crimes and treason, but just might include torture and the authorization of torture as well.
