Wayne County sheriff to halt mortgage foreclosure sales

DETROIT -- Wayne County Sheriff Warren Evans announced today that his office will halt all mortgage foreclosure sales.

Evans said a review of federal law has determined that to continue foreclosure sales would conflict with a recently enacted law that provides protection for homeowners.

"To proceed with sales without assuring that homeowners have been able to avail themselves of those protections would put me in a position of violating federal law," Evans said during an 11 a.m. press conference.

The Troubled Asset Relief Program that was approved by the U.S. Congress last fall requires the Secretary of Treasury to implement a plan to mitigate foreclosures, Evans said. He added it includes encouraging mortgage companies to modify loans to enable people to stay in their homes.

11. This confuses me. I didn't know that law enforcement was involved in sales of repossessions
Now I know the city can sell if the property is foreclosed because of back taxes. But I thought the banks were responsible fore selling their foreclosed homes for non-payment. I would like to see law enforcement say that they will no longer assist or take payment for evicting people whose homes have been foreclosed on. That would make a difference.

16. I knew they did evictions, but I didn't know thye were actaully involved in the sales.
everyone in my neighborhood that has lost a home (there are 3 or 4) have all moved out with no sign of law enforcement involvement. The homes are still sitting empty.

18. Execution sales are done by the County Sheriff in most states.
In fact this tends to be the #1 functions of most Sheriff Departments (Law enforcement is done by local or State Police Departments). Someone has to sell property of a debtor, and since the middle ages that has been the Sheriff. In some states (Pennsylvania for one) most sheriff deputies do NOT do any patrolling or other law enforcement activities except provide security at the local Court house and the ship prisoners to and from prisons.

A further function of the Sheriff in many states (Again I am using Pennsylvania as an example) is to serve legal papers on people. Some states permit anyone to serve writs, but in Pennsylvania that is reserved to the Sheriff. Thus you are sued in Common Pleas Court In Pennsylvania you first find out about the action when the Sheriff or his deputy drops off the complaint to you. No one else can serve you a copy of the Complaint. Many states permit others to serve legal papers, but many states, like Pennsylvania, reserves that right to the Sheriff or his deputies.

They often run the foreclosure auctions, too (ie "Sheriff's Sales").
