AG Holder reviewing all state secrets claims

WASHINGTON (AP) — Eric Holder, the new attorney general, has ordered a review of all claims of state secrets.

The Bush administration used the so-called state secrets privilege in past cases, including to block a lawsuit challenging a warrantless wiretapping program.

Justice Dept. spokesman Matt Miller said Monday that Holder has directed senior agency lawyers to "review all assertions of the state secrets privilege."

The move came even as federal prosecutors continued to invoke national security concerns in an appeals court in San Francisco, continuing the Bush Justice Department's position on that case.
