Former CIA exec gets more than 3 years in prison

ALEXANDRIA, Va. (AP) — A former high-ranking CIA official has been sentenced to more than three years in prison for a fraud scheme in which he steered procurement contracts to an old friend.

The 37-month sentence for Kyle "Dusty" Foggo, who held the CIA's No. 3 rank from 2004 to 2006, matched prosecutors' recommendations. He pleaded guilty to a single count of fraud.

Defense lawyers had argued for probation and cited Foggo's good deeds over two decades with the CIA, many of which remain classified.

Prosecutors said Foggo received tens of thousands of dollars worth of lavish gifts and vacations in exchange for helping his old friend, contractor Brent Wilkes, obtain no-bid contracts.

They also say Foggo forced the CIA to hire his mistress for a six-figure job for which she was unqualified.

So Foggo only gets 3 years! What a frickin' joke! I'm sure if we knew about what the other 27 of the 28 accounts he was charged with and had dismissed (for "security" reasons), we'd all be up in arms on this!

So that is why he's getting kid gloves treatment... He actually had the nerve to ask for a family vacation in Europe after he had these charges made against him...

I wonder if he was trying to "make good" with his wife, knowing that the details of his mistress relationships would be coming out shortly after that!

Fortunately in that instance, the judge drew the line properly and said no. You could tell though that he was "testing the waters" as to how far he could go with what he knows to get "nice treatment" towards him...

The attempt by the defense lawyers at trying to characterize this bum as "patriot", even though likely his more severe crimes are being covered up in this decision makes me ill. Good that the judge at least had the cahones to give the longer sentence he was able given what charges were actually adjudicated.

The CIA's former third-ranking official was sentenced to 37 months in prison today for corrupting the agency's contracts, the exact punishment sought by prosecutors who portrayed Kyle "Dusty" Foggo as an opportunist who tried to profit from the Sept. 11, 2001, terrorist attacks.

Foggo took advantage of the CIA's response to the attacks to steer agency contracts to a California businessman, prosecutors said. Foggo pleaded guilty in September to a corruption charge involving his relationship with the businessman, a former defense contractor and close personal friend. He is the highest-ranking member of a federal intelligence or law enforcement agency to be convicted of a crime.

"One man's crisis is another man's opportunity, and Mr. Foggo proved himself to be a very prolific opportunist," Assistant U.S. Attorney Jason Forge said at the sentencing hearing in U.S. District Court in Alexandria. "A man who exploits a national crisis should be humble enough to not call himself a patriot."

That drew a sharp response from defense lawyers, who said Foggo provided critical intelligence after the terrorist attacks, part of a lifetime of service during which he was shot at in the jungles of Central America. "When the story of America's response to Sept. 11 is written, Dusty Foggo's work can and should be seen to have played a very important role," said Mark MacDougall, an attorney for Foggo. "A sinner he may be. A criminal he is, but he is surely a patriot." Defense lawyers sought a sentence of probation. But U.S. District Judge James C. Cacheris sided with prosecutors, saying Foggo had benefited from his relationship with the contractor and had pressured CIA officials to hire his longtime mistress. "You were a good employee for the CIA for over 20 years, and you obviously did some good work," he told Foggo. "But still, this was such a scheme, for such a long period of time, that a sentence of 37 months is appropriate."

37 months,justice once again takes a holiday.White collar crime,a little time,blue collar crime,you must do the time you low life criminal.Off to the country club prison,visitation rights for the girl friend and wife,don't confuse the dates for their visits.
