Probation likely for Oakland County commissioner charged with indecent exposure

Novi -- An Oakland County commissioner facing an indecency charge after he and a woman were found naked on a city street last month is expected to receive some form of probation, according to a statement released Friday by the district judge who is handling the matter.
Commissioner Kim Capello, R-Novi, is charged with indecent exposure following an April 18 incident near the Post Bar and the city's Main Street area. A police report obtained by The Detroit News reveals that an officer was directed to the area by a resident who believed they were involved in a sexual act.
When the officer put his patrol car spotlight on the pair, he found them both up against a 3-foot tall brick wall near a sidewalk, their clothes on the ground. Both the 56-year-old Capello and the 37-year-old woman admitted they had been drinking prior to the 2 a.m. incident.
Capello and the Novi woman -- who has yet to be arraigned on her offense -- are both charged under a city misdemeanor ordinance, punishable by up to 93 days in jail and fines. But according to a statement released by Novi District Judge Dennis Powers' office Friday, Capello made a guilty plea at his arraignment Tuesday, which will likely result in him being placed on probation.
