Update: Franken brief rips merits, quality of Coleman case

If you read the earlier quick reaction to the Al Franken brief, this is a complete redo from the top.

Team Franken's reply brief (PDF)http://www.minnpost.com/client_files/pdfs/FrankenRespondentBrief.pdf attempts to rebut, disassemble and really demolish every aspect of Team Coleman's case. Of course, that's what a brief is supposed to do. The brief was direct and aggressive in urging the court to not only declare Al Franken the winner of the election but also to order Gov. Pawlenty to issue an election certificate without any shilly-shallying.

At times, the brief seemed to cross the line from calling Norm Coleman's arguments weak to accusing Coleman's lawyers of doing a lousy job with such a case as they had.

I'll be interested to see how Team Coleman tries to reply (in case you've lost your program, this is the one and only briefing opportunity for Franken during this, the state Supreme Court appeal. Coleman, who already filed his appellate brief, gets one more crack in a written reply due Friday. The Court will hear oral arguments on June 1. Then it's decision time.

1. Coleman is a CLASSLESS ASSHOLE of the PUTRID KIND...He is NOT A MAN by any stretch anywhere...
He is part of the reason the GOP is fucked up....no one to tell to give it up and show some Dignity

This petty resistance to Reality displays to the World...the utter disregard for the STATE and the Nation....

Self centered and Obstinate...he makes a fascinating study in Political Suicide....

A def short termer......thinks in small time frames

purposely prolong it for the republicans and take many month's if accepted, to get a final verdict....and with this current Bush republican court, who knows....Coleman has nothing to lose, only gain....and tit to the Supreme court will also help the republicans as they can continue to stall and keep a critical democratic elected vote from voting....

9. The MN Supreme Court will uphold the 3 judge panel ruling and order Franken to be certified.
Then he will be seated in the Senate and Coleman can appeal for as long and as far as he can, but this will not go on for months without Franken being seated in the Senate.

The sooner Franken is seated, the sooner people will be able to pretend this never happened.

I want this mess to lock Republicans out of Minnesota for the next forty years.

4. Seat Franken now. With a filibuster proof stable of 60 Senators, we will own the Republicans
Colman and the Republican National Committee have strung this out long enough. We have the votes to utterly crush the rethugs in Congress, and it has come high time to put them in a corner.

7. Between the blue dogs and Specter, Democrats may not always be fillibuster proof. However,
having 60 Democrats will be a huge psychological factor and it will also put the pressure on Specter and the blue dogs. So, th 60 figure is neither a golden guaranty nor chopped liver. I'm putting it at closer to golden, though.

12. I fear that as well. The Minn. Court has a lot of Pub appointees and we all know about the
SCOTUS. Still, these briefs, the oral arguments and the decisions will probably get studied for a long time to come, along with Bush v. Gore.

13. Well, you won't get relief you don't ask for!
and of course, it behooves one to provide the court with sound and compelling reasons to grant that relief. That said, my bet is that the court's watched the matters closely and knows what it's going to do.

One thing for certain- if they overturn the results, all hell's going to break loose and their reputations will be tarnished ever after.

10. 21 Democratic senators support a public option for health care.
21 out of almost 60.

We don't have nearly 60 democrats in the senate. We have 20 or 30. There are far larger problems than norm coleman, but this makes good theatre and provides yet another excuse.
