A GERMAN judge yesterday quashed a conviction against the only person jailed in connection with the 11 September attacks, saying the fight against terror cannot be "a wild, unjust war".
The judge, Klaus Tolksdorf, ordered a retrial for Moroccan-born Mounir El Motassadeq, who was sentenced to 15 years in jail in February 2003 for conspiring to murder nearly 3,000 people in the 2001 attacks in the United States.
Motassadeq, who was also convicted of being a member of a German-based al-Qaeda cell that included three of the suicide hijackers, had his convictions overturned after an appeal court ruled he had been denied access to a vital witness who could have cleared his name.
The man, a suspected al-Qaeda operative, Ramzi bin al-Shaibah, is being held by the US, which has prevented him appearing as a witness.
