Brazil top judge orders US boy returned to father@
BRASILIA (Reuters) - The Brazilian Supreme Court's top judge ruled Tuesday that Sean Goldman, the boy at the center of an international custody battle, must be reunited with his father and return to the United States, a press officer at the court told reporters.
American David Goldman has been fighting to bring his son home since 2004 when his then wife, Sean's mother, brought the boy to her native Brazil and then divorced Goldman. She died last year.
The ruling by chief justice Gilmar Mendes is preliminary and needs approval by the full court, but it is immediately binding and could therefore allow Goldman to take his son back to the United States.

12. They've been lying to him since his mother died, he asked why his dad
never came to see him when he actually has tried since 2004. For 5 years this powerful family had this case blocked using their friends using the system to keep this man from his child...it makes you wonder why the State department or his congressman did not get involved in 2004 or anytime before 2008.

One of our managers friends was in Rio some of the people wanted this child returned as this was giving them bad press and this man was using his money to kidnap someone's child not to mention the upcoming Olympics issues with the gang violence.

14. Was this a Catholic versus Jewish battle in our modern world?
I would not be surprised, just don't really know why this whole thing took so long, but religious background differences might play into it, for sure.

One only wonders until this is established as fact.

If so, religion is again canceling out logic.

34. You don't watch enough movies
With the evil Brazilian auhorities only speaking English to each other with a Spanish accent (as opposed to Brazilian portuguese). So you can't really blame the American audience for being a little anxious until the kid leaves Buenos Aires, can you?

41. Yes, my impression of the biological father is not positive. I'm more inclined
to trust the intentions of the Brazilian family ... even if they're EVIL foreigners, they are also blood kin with more resources than the seemingly "attention whore" dad.

28. Court orders Brazilian family to relinquish boy (has until Thursday at 9AM)
Source: AP

A federal court has given a Brazilian family until Thursday morning to turn over custody of a 9-year-old boy to his U.S. father.

The court in Rio de Janeiro released a statement Wednesday afternoon saying the Brazilian family has until 9 a.m. Thursday to deliver Sean to his father, New Jersey resident Sean Goldman.

The court's order follows a ruling Tuesday by Brazil's chief justice, who upheld a previous court decision ordering that Sean be returned to Goldman.

33. I think that's why the court decision is so difficult
Edited on Wed Dec-23-09 02:37 PM by Meshuga
Because of the welfare of the boy. It is just and fair that the boy is being returned to his father but the child is going to a (demonized) stranger's home in a strange country. Plus, the father is not rich like the step-father's family in Brazil so the standard of living is going to change quite a bit as well.

If a kid is stolen, its not his choice with good reason.

This has been going on a LONG time before it was ever publicized. Read up: http://bringseanhome.org/

32. Unfortunately this may not have a happy ending.
The boy has probably been brainwashed to hate his father. It is doubtful that his feelings will change at the age of nine. The father would have been better off starting a new family and reuniting when the boy was an adult. Only time will tell and none of us can be sure of the future. I wish the father luck.

35. Still a happy ending...
Would you allow a kid to stay in a cult because he'd been brainwashed? Imagine if your kid was in the Manson Family. Or Elizabeth Smart or Jaycee Lee Duggard. Would you just leave them wher they were because they'd been brainwashed?

36. Well, as a parent, I can tell you I wouldn't be very happy with that
solution. I wouldn't willingly give up that time with my son.

Nine is not too old to realize that his father loves him, and will care for him.

47. I think it's news because..
Most of us who are parents can identify with the biological father's anguish. he has done nothing wrong, all reports are that he was/is an excellent, attentive and competent parent. And yet he is being denied the opportunity to raise his own child. I, for one, have been following the case with great interest, and I am very thrilled that it looks like Dad and child will be able to be together once again. I pray that they both will be able to heal from the wounds of these last five years.
