Top SC Prosecutor, Others Probing Health Care Deal(Nebraska Funding Break)

The top prosecutors in seven states are probing the constitutionality of a political deal that cut a funding break for Nebraska in order to pass a federal health care reform bill, South Carolina's attorney general said Tuesday.

Attorney General Henry McMaster said he and his counterparts in Alabama, Colorado, Michigan, North Dakota, Texas and Washington state — all Republicans — are jointly taking a look at the deal they've dubbed the "Nebraska compromise."

"The Nebraska compromise, which permanently exempts Nebraska from paying Medicaid costs that Texas and all other 49 states must pay, may violate the United States Constitution — as well as other provisions of federal law," Texas Attorney General Greg Abbott said.

McMaster's move comes at the request of Republican U.S. Sens. Lindsey Graham and Jim DeMint of South Carolina.

1. Allowing myself to agree with Lindsey Graham is making my head hurt,
but I do think the Nebraska deal was bullshit.

COLUMBIA, S.C. - The top prosecutors in seven states are probing the constitutionality of a political deal that cut a funding break for Nebraska in order to pass a federal health care reform bill, South Carolina's attorney general said Tuesday.

11. The idea of federalism is based on all states being treated equally
It is one thing to give Louisiana $300 million in pork goodies to get Mary Landrieu's vote, quite another to have 49 states paying for Nebraska's share of Medicaid.

Louisiana's share of that is probably very small. I don't see a difference, except possibly in amount.

14. It's not federalism.
It's the screwed up current Senate rules.

Those need revising so that the majority rules and that filibuster crap goes. Somebody (I'm too lazy to look it up) had a NYTimes column just recently about how the Repukes have used it like crazy the last year to stonewall Dem legislation, compared to hardly any use before.

17. Gotta say it's painful but I can't disagree with what they're doing.
The Nelson deal is pretty tough to swallow. Although... I expect it's not all that different from thousands of other deals cut in the past, by both parties.
