Appeals court rejects bid to block posting of Proposition 8 trial on YouTube

A federal appeals court on Friday rejected a bid by Proposition 8 supporters to block the broadcast of the upcoming trial involving a challenge to California's same-sex marriage ban, refusing to stop a plan to post the proceedings on YouTube.

In a one-paragraph order, the 9th U.S. Circuit Court of Appeals said that the Proposition 8 campaign had not presented reason for "intervention by this court" in the broadcast issue.

Lawyers for the Proposition 8 campaign had argued that Chief U.S. District Judge Vaughn Walker did not have the legal authority to permit cameras in the trial, which is set to begin Monday in San Francisco. Proposition 8 backers say that broadcasting the proceedings "is likely to negatively affect the fairness of the trial."

1. What the Prop 8 backers are afraid of is that it will result in a fair trial
where everybody can see their bigotry and hate in action.

Proposition 8 supporters today moved to block the broadcast of the upcoming trial involving a challenge to California's gay marriage ban, asking a federal appeals court to put a stop to a plan to post the proceedings on YouTube.

In court papers, lawyers for the Prop. 8 campaign argue that Chief U.S. District Judge Vaughn Walker did not have the legal authority to permit cameras in the trial, which is set to begin Monday in San Francisco. Proposition 8 backers say that broadcasting the proceedings "is likely to negatively affect the fairness of the trial."

The Proposition 8 backers did not ask for a delay in the trial. But the Prop 8 legal team filed an emergency petition with the 9th U.S. Circuit Court of Appeals, asking the appellate court to intervene and block the broadcast until their arguments can be addressed. The documents warned that Walker's decision to broadcast the trial on YouTube threatens to turn it into a "media circus."

... Walker rejected the campaign's arguments against cameras earlier this week, authorizing delayed video of the trial to be posted through YouTube with court-operated cameras in his courtroom.

11. Tell the hateful bigots to wear white hoods if there so worried.
I hope there broadcast on youtube, and I hope everyone involved fighting agaisnt equal rights are treated exactly the way they should be-shunned by their neighbors, there business boycotted, etc etc.

14. Well, I've never been in favor of televised trials
There are reporters there to document the proceedings, we don't need another O.J. Simpson-like circus atmosphere. I suspect the supporters of prop 8 will lose, as they should, but I don't see a benefit of televising.

21. It's not behind the scenes
It's still in a courtroom in public where they can be seen. Seeing them on television may help make you feel superior but it's not going to help make the proper verdict. If they want to tape it for later viewing on YouTube after the trial is over, then fine. But showing it while the trial is still going on serves nothing but stirring up angry feelings. You know, not everyone who supports prop 8 is evil incarnate just weak-minded people who are easily led.

Well, depends on what the trial is. Unlike the OJ trial, this is all about the public and a public issue. So put it somewhere for the public to see.

22. You can see that already on YouTube and other places
plenty of ignorant people at rallies and elsewhere willing to speak to the camera. Even a couple of men who I play poker with made it clear they thought gay marriage was indecent. Of course, I let them know my STRONG disagreement with that.
