U.S. Court Sends Back Mumia Abu-Jamal Death Penalty Case

The U.S. Supreme Court on Tuesday granted an appeal by prosecutors and set aside a ruling that invalidated the death sentence of black political activist Mumia Abu-Jamal for the 1981 murder of a Philadelphia police officer.

His case has become a prominent cause for many death penalty opponents.

In a brief order, the Supreme Court sent the case back to a U.S. appeals court based in Philadelphia for further consideration in view of the high court's recent decision in an Ohio case that had raised similar issues.

The Supreme Court in the Ohio case unanimously reinstated the death sentence of a neo-Nazi convicted of murdering three men. The court's action, which was not a ruling on the merits of the case, could lead to Abu-Jamal's death sentence being reinstated, too.

The appeals court had ruled that Abu-Jamal, 55, deserved a new sentencing hearing because of flawed jury instructions.

2. Jesus and a lamb?
Is that Jesus and a lamb in your post? Or is that your giant ego ready to sacrifice a lamb to some idol you enjoy worshiping?

The incongruity of your vile and hateful message with the image of a man who said, "Father forgive them" is just amazing to me.

The evidence in the case disappeared. The bullet they said killed the officer disappeared...how convenient. A lot of evidence was convenient in that case. I don't know if he was guilty or not but when evidence disappears and can't be verified there's something wrong somewhere. The cops wanted someone, they picked the nearest black man. Go figure...same crap happens in my town with the bad cops (there are good ones, but the union makes it hard to dump the crap).

6. That's Lemmy as Jesus.
Lemmy Kilmister is the singer/bassist from Motorhead.

The evidence did not disappear. They found Cook on the street, shot by the officer, with the gun used in the murder. They did not just grab some "random black guy". This is a no doubt about it case.

Death penalty to all incarcerated black men! They're all assholes, whether or not there's any actual evidence against them Just kill them all and let God sort them out!

Of course Lemmy is god but he's not Jesus.

How is finding Cook on the street, shot by the murdered officer, with the murder weapon in his possession not evidence? You have been listening to the nonsense propaganda. This asshole, and yes cop killers are assholes, was caught red handed.

who are close to the case. It's the same crowd that literally ran with MLK. But you, who know nothing of the case other than what you've read from obviously biased sources, believe he should be killed. Regardless of who your god is (and Motorhead is NOT god), that you're so enthusiastically wishing the death of a fellow human being speaks volumes about your heart and soul.

10. I said Lemmy was god, not Motorhead.
Motorhead is just a great Metal band. And I am very familiar with the case, I remember when the incident happened when I was a kid. Cook is absolutely guilty, is no hero in the mold of MLK and certainly had no problem murdering a police officer. He was caught red handed, shot by officer Faulkner, with the murder weapon. The ballistics matched, he had the powder on his hands, he did it. And yes I am more than happy to see filth like that exterminated.

All the evidence that the prosecution fixed this trial, and that the prosecutor's story could not have happened, and all the missing evidence, and blatant racism that went into every stage of railroading this guy, and you think he should have been executed?

There have been few cases more blatant in how desperately everyone involved wanted to convict someone and kill someone regardless of the facts or evidence.

11. If there is so much evidence that he prosecution fixed the trial, why hasn't Mumia's lawyers been
able to convince any courts to overturn his conviction?
