H-1B applications to be accepted from April one

WASHINGTON: The US will start accepting the applications for H-1B visas, most sought after by Indians, from April one for the fiscal 2011.

In a statement, the US Citizenship and Immigration Services (USCIS) said it will accept petitions for 65,000 H-1B visas as mandated by the Congress.

"Cases will be considered accepted on the date that it takes possession of a properly filed petition with the correct fee; not the date that the petition is postmarked," the statement said.

The first 20,000 H-1B petitions filed on behalf of individuals who have earned a US master's degree or higher are exempt from this 65,000 cap.

If needed, USCIS will randomly select the number of petitions required to reach the numerical limit from the petitions received on the final receipt date, the statement said.

Petitions for new H-1B employment are exempt from the annual cap if the beneficiaries will work at institutions of higher education or related or affiliated nonprofit entities, nonprofit research organizations or governmental research organizations.

there are more unemployed "High Tech" engineers
then there are H1B visas.

That means that if every H1B visa engineer had their
visa canceled, there would still be US engineers
unemployed.

I say that the limit on H1B visa's should be tied to
the unemployment rate. The higher the unemployment rate,
the lower number of H1B visas. The lower the unemployment
rate, the higher the H1B visas.

This H1B program creates unemployment for highly educated and skilled American workers, and replaces them with Indians who American companies hire for lower wages.

This H1B visa program stinks in this respect, and especially at this time.

26. What world market?

I am a systems administrator. A machine breaks down, I have to bring it back up as soon as possible. Sometimes I have to go to the machine and replace parts.

How is someone from India going to do my job unless he gets an H1-B visa and comes here?

Most of the machines I work on are for popular web sites. Don't tell me that these servers are going to move out of San Francisco or New York and over to Calcutta and the web sites people will be accessing will be in Calcutta. If that's what is about to happen, why hasn't it happened over the last 15 years? Its conceivable that might happen in a few decades but I'll be dead by then. Once India puts down its Maoist rebellions and has clean, hot water coming out of the faucets and electricity flowing 24/7/365 you can tell me about how I have to compete with someone over there. I only have to compete when they come in on an H1-B visa.

That tens of thousands of people are coming into the US this year to take jobs on this visa when unemployment is 9%-10% is absurd. People are going to the streets and hanging from lampposts the people who own these companies and their lackies, not worrying about bogus nonsense like the "world market". Like that guy who killed his boss at OSU today after getting reprimanded. If every boss in this country feared for his life before reprimanding a "subordinate", this country would be a much, much better place.

14. If the Obama administration suspended the H-1B visa program

until such time as there was full employment among American tech workers, it would immediately raise the fortunes of the Dems.

Another visa program to look at is the one that allows resorts to hire foreigners for the summer. I bet there are a lot of unemployed Americans who would be happy to get free room and board and some money to make beds and wait on tables.

Just a thought:

What we need is a registry of unemployed tech workers - made available to USCUS.

Theoretically all these employers are telling USCIS that there are no available US workers (unless they gave up on even that fraud). The employers could hardly claim no US workers if they had to look at the registry.
