(11-03) 06:07 PST SAN FRANCISCO -- “….A federal judge has declared a mistrial in the case of a Del Norte County man who was indicted on charges that he threatened in an e-mail to kill President Obama and members of his family….On Monday, jurors told U.S. District Judge Marilyn Hall Patel in San Francisco that they were hopelessly deadlocked in the trial of John Gimbel, 59, of Crescent City, who had been accused of writing an expletive-laden e-mail that threatened Obama, his wife and their children. …"This shows that an intelligent jury can work through the profanity and racial epithets contained in the e-mail and follow the judge's instructions as to what a true threat is," said Gimbel's attorney, Michael Stepanian…. On Sept. 28, 2009, Gimbel e-mailed a message bearing a subject line that read, in part, "Kill the 'president'... then write 'fed s-' on his chest with a felt tip," said the indictment issued in October 2009, when Obama visited San Francisco for fundraisers at the St. Francis Hotel…..”
