(CNN) – Lawyers for the gay group seeking a repeal of the military ban on openly gay troops serving in the military have asked the Supreme Court Friday to reinstitute a recent ruling to immediately stop the military ban.

A gay GOP group is asking the Supreme Court to reinstate a lower court's order banning the military from enforcing the "don't ask, don't tell" policy which prohibits openly gay service members.

The Log Cabin Republicans, who filed the suit that produced the short-lived injunction against "don't ask," submitted an application Friday asking Justice Anthony Kennedy to, in effect, ice the policy while the Justice Department pursues an appeal to revive it. (Read the application here.)

The Log Cabin move appears to face long odds at the Supreme Court, at least right now. In major cases, justices usually refer such applications to the full court. In this instance, Justice Elena Kagan would be expected to recuse since she played some role in strategizing about the case. In the eyes of many observers, that would leave four conservative justices (Roberts, Alito, Scalia, Thomas) likely hostile to a legal challenge to "don't ask" facing down three liberal justices (Breyer, Sotomayor, Ginsburg) who might be open to it.

2. Well, there's more Republicans on the Supreme Court.
So maybe they'll be more receptive to a Republican group petitioning them.

Might be for the best that the Log Cabiners filed this petition, and not a left-wing group that might automatically turn off Roberts and Alito.

In any case, this is probably our last shot at seeing DADT repealed in the near-future, unless the Democrats in the Senate grow a spine during the lame-duck session and ram it through before the Republicans take over the House.

It's not a matter of willpower: the Senate needs all the Dems plus two Republicans to get cloture.

There's a word for that.

Completely aside, remember the "Gang of 14," the Senators--including 7 Democrats--who pledged to oppose any such move? Four of those Dems are still in the Senate, and you need a majority vote to approve the "nuclear option." Show me the evidence that there's 51 Democrats willing to toss the filibuster. I don't think you'll find them.

10. The Republicans will use it once they attain majority, so why not?
We can't get anything done if we don't get down and dirty and play like they do.

hates gays. Simple fact. Maybe in 2012 when he Dems get back in this matter thru congress will be resolved. The 5 Gop justices don't like gays.
