Kagan, Thomas Take Part as Top Court Rejects Health-Care Appeal
Source: Bloomberg

By Greg Stohr

Nov. 8 (Bloomberg) -- The U.S. Supreme Court refused to revive a challenge to President Barack Obama’s health-care overhaul, leaving intact a ruling that said a California man and interest group filed their lawsuit prematurely.

The case marks the first time the high court has been called upon to act on the health-care law, which is also being challenged by 20 states in two lawsuits.

In rejecting the appeal, the justices dropped a hint that all nine of them will take part if they ultimately consider the law’s constitutionality. Two justices whose participation has been the subject of discussion -- Elena Kagan and Clarence Thomas -- both took part in today’s action.

Kagan, who served as Obama’s top courtroom lawyer before he appointed her to the Supreme Court, was pressed by Republican senators considering her nomination this year to say whether she would disqualify herself from disputes over the health-care law.

She said in a written response to questions that she played no role in formulating the administration’s legal defense, though the litigation was briefly mentioned at least at one meeting she attended.

1. Unless that scumbag Clarence Thomas
recuses himself first there is no way in hell that Kagen should even be asked to consider it. You know that Thomas will never recuse his sorry ass in any case that may benefit him or his equally fucking crazy wife.

4. I'm guessing Clarence probably re-stocked her medicine cabinet and liquor supply
and took her phone privileges away for opening that almost 2 decade long bag of worms.

Poor poor Ginny.

7. But they will try - here is what they are starting with -
Let's face it the repub's have no intention of getting rid of the cash cow mandate -

"House Republican whip, Congressman Eric Cantor of Virginia said, “If all of Obamacare cannot be immediately repealed, then it is my intention to begin repealing it piece by piece."

The New York Times reports Republican lawmakers plan to use spending bills to block various provisions which they object to and limit access to government-subsidized private health plans that include coverage of abortion.

In addition, Republicans want to limit money and personnel available to the Internal Revenue Service, so the agency could not aggressively enforce provisions that require people to obtain health insurance and employers to help pay for it." - Democracy Now
