Martin Erzinger, pictured, allegedly struck a cyclist with his vehicle. He will not face criminal charges due to the district attorney's concern for Erzinger's career. A Morgan Stanley wealth manager will not face felony charges for a hit-and-run because Colorado prosecutors don't want him to lose his job.

Martin Joel Erzinger, who manages more than $1 billion in assets for Morgan Stanley in Denver, is being accused only of a misdemeanor for allegedly driving his Mercedes into a cyclist and then fleeing the scene, Colorado's Vail Daily reports. The victim, Dr. Steven Milo, whom Erzinger allegedly hit in July, suffered spinal cord injuries, bleeding from his brain and, according to his lawyer Harold Haddon, "lifetime pain."

But District Attorney Mark Hurlbert says it wouldn't be wise to prosecute Erzinger -- doing so might hurt his source of income. Here's Vail Daily:

"Felony convictions have some pretty serious job implications for someone in Mr. Erzinger's profession, and that entered into it," Hurlbert said. "When you're talking about restitution, you don't want to take away his ability to pay."
"We have talked with Mr. Haddon and we had their objections, but ultimately it's our call," Hurlbert said.

5. I'm all for leniency, but how about being as lenient with the poor

as with the rich. A felony charges ruins the careers of everyone who is charged. So let's only charge people when it is really needed -- and I think it is needed for the folks on Wall Street, but perhaps not for this accident. I say I don't know whether it would be appropriate for the accident because I don't really know the facts. I couldn't find the article on Huffington Post. Don't know if Hurlbert can be recalled or fired. He should be forced out of his job. This is inexcusable. Not only is Hurlbert not performing his duties, his explanation for not pressing charges reveals Hurlbert is not mentally competent to carry out his responsibilities. Dr. Milo could have suffered permanent paralysis or worse, being left in a ditch! Immediate medical attention was needed and Erzinger fleeing the scene may have contributed to the extent of Milo's injuries and Milo could have died had he not received care when he did.

District Attorney Mark Hurlbert Accepts Bribes?
One has to wonder how much money District Attorney Mark Hurlbert accepted to allow this crime to go unpunished:

Dr Milo was bicycling eastbound on Highway 6 near Eagle when Martin Joel Erzinger allegedly hit him with the black 2010 Mercedes Benz sedan he was driving.

Erzinger fled the scene and was arrested later, police say. He drove until he reached a Pizza Hut parking lot, where he stopped and called Mercedes auto assistance to report the damage to his vehicle.

That's a felony hit-and-run. Everyone criminal lawyer knows this. It's a serious crime. What's worse is that Erzinger called to report damage to his own car rather than call 9-1-1. An ethical prosecutor would say in court, "That's an aggravating factor evidencing a lack of remorse. It also shows a truly depraved individual who elevates the condition of his expensive car to another person's life!"

Nevertheless, District Attorney Mark Hurlbert violated his oath of office, and violated the Colorado Rules of Professional Conduct, by treating a rich criminal defendant "more equally" than

Having the misfortune of living in his district, I follow and write about disastrous DA Mark Hurlbert more than anyone. He had no problem accepting the maximum limit of campaign contributions from Ali Hasan and his family, the leading Muslim contributor to GOP candidates in the US (head of Muslims for Bush). He failed to recuse himself from a criminal investigation into Hasan in 2008 and ultimately no-filed the case behind closed doors, despite both Hurlbert and Hasan both being active Republicans in Vail and Breckenridge.

I would agree with your conclusion about the bribe but for one factor - Hurlbert seems to have a general reversal of priorities in prosecution that calls for going light on serious cases and Ahabesque-obsessive on stupid cases. He charged two veteran women mountain bikers with felonies for swapping race bibs in a local amateur race -http://wp.me/pzqev-jC; he is prosecuting for the third time a guy for kiddie porn, despite two prior hungs - the last 9-3 NG; he prosecuted relentlessly a kid who threw a snowball at someone without injuring the person. It goes on and on an on with this guy.

Then, another guy without provocation and in a drunken rage pulls a black woman buy her hair across the floor of a bar, pulling half of it out, while screaming the n-word and c-word at her. Rightfully charged with a felony, Hurl pleads the case to a misdemeanor and 60 days work release.

A financial manager will not face felony charges for a hit-and-run, prosecutors said Thursday.

Martin Joel Erzinger, 52, faces two misdemeanor traffic charges stemming from a July 3 incident when he allegedly hit bicyclist Steven Milo from behind then sped away, according to court documents.


Milo, 34, is a physician living in New York City with his wife and two children, where he is still recovering from his injuries, court records show.

Milo suffered spinal cord injuries, bleeding from his brain and damage to his knee and scapula, according to court documents.
