Gov.-Elect Cuomo Opposes 9/11 Trial in New York

New York Gov.-elect Andrew Cuomo says he's against trying the professed mastermind of the Sept. 11 terror attacks in his state.

The Democrat addressed the matter for the first time in an interview with radio host John Gambling on Thursday, a day after Attorney General Eric Holder said the Obama administration was close to deciding where to prosecute Khalid Sheik Mohammed.

Cuomo simply said "no" when asked for his opinion about whether Mohammed should be tried in New York. When asked if he would fight to keep the trial away, Cuomo said yes.

New York Sens. Kirsten Gillibrand and Chuck Schumer, along with New York City Mayor Michael Bloomberg, also oppose a civilian trial in New York for Mohammed.

2. Crime was committed in New York. Certainly should be tried there.

Professional pant-wetters need to realize that actually prosecuting crime and administering legal punishments is far preferable than holding someone without charges and torturing them. Might want to check the old Declaration of Independence for a list of abuses that we revolted against.

I didn't think it would be that quick before I was disgusted with Cuomo. It's going to be a long 4 years (probably more). Oh and I work several blocks from the Southern District Courthouse.

6. But there is plenty of precedent

for taking a trial out of the community where the crime was committed. Hard for a jury to be impartial. I still like Andrew Cuomo and his father.

4. Then shouldn't all New York crimes be tried in say... Michigan?

And Michigan can charge New York for the costs. Oh and how about placing federal jurisdiction in the hands of California federal prosecutors instead of New York? And the cost for that goes to New York too.

7. The 6th Amendment requires the trial to be held in the

jurisdiction where the crime was committed. I believe the crime was committed in New York.
