Congress Bans 'Crush' Videos

WASHINGTON — Videos appealing to a sexual fetish by showing women killing small animals will be banned under legislation that cleared the Senate Friday and is heading to President Barack Obama for his signature.

The voice vote in the Senate followed a vote in the House on Monday to ban so-called crush videos that depict the abuse and killing of animals.

Congress banned such videos in 1999, but the Supreme Court earlier this year struck down the law, saying it was too broadly written and violated First Amendment free speech protections.

The more narrowly crafted bill going to the White House makes it a crime to sell or distribute videos that violate bans on animal cruelty by showing animals being burned, drowned, suffocated or impaled.

It's selling, distributing and perhaps owning the video after the fact that's made illegal here.

The fact is, it's not like this is a pressing problem, here. This is the sort of thing that's a niche of a niche of a niche in the porn market. It's pretty much a waste of Congressional time. I bet over the next decade they have about ten investigations and one conviction, but, hey, that's one less pervert who got away with feeling a repulsive pleasure.

25. No. The laws pertain to animal cruelty
Possessing a video of somebody else committing animal cruelty is not illegal under those statutes. Murder is illegal. If I videotape a murderer committing murder and market the tape, that is not illegal. Of course, the cops will seize it as evidence for the trial, but I still own the tape and can market it after it has been used as evidence.

the act is, was always illegal (unless the creature did not fall under the definition of animal for the purpose of animal cruelty statutes. For example, a cockroach).

But possessing and disseminating the visual depiction IS a form of speech. However, it is still prohibitable, but wasn't actually prohibited until this legislation.
