Judge strikes down Walker's collective bargaining law
Source: Wisconsin State Journal

A judge has struck down Gov. Scott Walker's controversial new collective bargaining law.

Dane County Judge MaryAnn Sumi issued a permanent injunction against the law Thursday morning. This means the law is effectively dead until the Wisconsin Supreme Court acts on the law.

Sumi's decision said there was "clear and convincing evidence" that Republicans who control the Legislature violated the state's open meetings laws. And she said that means the law is void.

MADISON — Wisconsin's law taking away nearly all collective bargaining rights from most public workers was struck down Thursday by a circuit court judge but the ruling will not be the final say in the union fight that brought tens of thousands of protesters to the Capitol earlier this year.

The state Supreme Court has scheduled arguments for June 6 to decide whether it will take the case and Republicans who control the Legislature could also pass the law a second time to avoid the open meeting violations that led to the judge's voiding the law Thursday.

Gov. Scott Walker pushed for the law as a way to help balance the state budget. His spokesman had not seen the ruling and had no immediate comment. Spokesmen for Republican leaders in the Legislature also did not immediately return messages seeking comment.

Walker and Republican leaders have said they would pass the law again as part of the state budget next month if necessary.

8. Unfortunately this is only a procedural issue. They'll just re-vote to get around that.
AND, I may be wrong but I'd bet that the Democratic Senators won't be leaving the state for the next vote, so unless a few publican senators see the light it's only a matter of time 'till Walker gets his way on this.

10. Maybe some of the gopers
will vote against it now especially the six who probably will be recalled. I think Walker and his cronies are on their way out, thank goodness. These people are power hungry and can I say Heil Walker, Heil Kasich (sp?), Heil Synder, Heil Daniels, Heil Scott, Heil Christie, Heil the rest of the gop governors and their legislators. They claim they want small government all the while lying through their teeth. Ugh, they want the corporations to run this country and eff the people, we are nobody to them.

17. You are absolutely right
Some of the first laws these guys passed and are still passing are laws that protect a companies liabilities against the public safety. They've left the public with little legal recourses in any law-suits. If we have any complaint, we have no recourse...no rights. Took away regulatory measures for any poisoning of our lands and water. Now has even signed a measure removing testing of our water...leads me to believe he's planning on opening WI to all sorts of polluters. (think fraking and smokestakes and oil rigs in Lake Michigan)

14. Now let us see if they'll re-vote for it
and how they vote. I don't think they'll change their votes. It looks to me like nationally they are being told to hold the line even if they meet their demise.

I'm thinking they think they have their jobs forever with voter ID and other suppression tactics, so we'll really have to get people out to vote...

Huebsch, Fitzgeralds look to Supreme Court

DOA Secretary Mike Huebsch and GOP legislative leaders said they would look to the state Supreme Court now that a Dane County judge has invalidated the collective bargaining changes.

“We look forward to the reforms of the budget repair bill being enacted in the near future," Huebsch said in a statement. "We will continue to pursue legal action with the Supreme Court in an effort to protect middle class jobs and middle class taxpayers.”

Assembly Speaker Jeff Fitzgerald, R-Horicon, said Act 10 "was passed and signed into law in accordance with the rules of the state legislature."

"There’s still a much larger separation-of-powers issue: whether one Madison judge can stand in the way of the other two democratically-elected branches of government," Scott Fitzgerald said.

35. A win/win situation for Democrats in Wisconsin
Even if the GOP votes again and passes the measure, all that will do is re-ignite anger. The elections are set to go this time. People will be scrutinizing the candidates and their votes. Some of the GOP may get cold feet and who knows, maybe not vote or vote against the plan. Their political careers are at stake this time.

It's warm weather now. Who knows how the rank and file union membership will react. The first vote was an assault. The second one is an act of war.

I would not be so quick to cast my lot with Walker if I were a lawmaker in Wisconsin. His days seem to be numbered.

39. Before everyone gets too excited...
As someone who works for the Government, let me say that this is a PROCESS ruling. The Court is NOT saying the law is Unconstitutional or that the Legislature doesn't have any right to implement it; they're saying the rules as to HOW the law was to be passed weren't followed. As long as they revote under the terms of the Open Meetings Law (and as far as I know they still have enough votes to pass it) it can still go into effect.

We need to reelect President Obama for no other reason than to get a liberal Supreme Court appointment.

The United States is a left leaning, liberal country. The Republicans lie their way into office and pass legislation by deception and trickery. The courts are where we set straight the errant Republicans and return to the liberal interpretation of the Constitution that the majority of citizens want.

The courts have half the power in this country, and we need to keep them on our side.
