Judge dismisses Ariz. governor’s lawsuit against feds over border enforcement

A federal judge Friday dismissed Arizona Gov. Jan Brewer’s lawsuit that accused the Obama administration of failing to enforce immigration laws or maintain control of her state’s border with Mexico.

The dismissal by U.S. District Judge Susan Bolton comes in a counter-lawsuit filed by Brewer as part of the Justice Department’s challenge to Arizona’s controversial immigration enforcement law. The Republican governor was seeking a court order that would require the federal government to take extra steps, such as more border fencing, to protect Arizona until the border is controlled.

The Department of Justice issued a one-sentence statement saying it was pleased by Bolton’s decision.

The DOJ sued the state of Arizona last year in a bid to invalidate Arizona’s immigration enforcement law. Bolton put key parts of the law on hold, such as a provision requiring police, while enforcing other laws, to question a person’s immigration status if officers had “reasonable suspicion” the person was in the country illegally.

2. Janet Napolitano had the same problem with the feds
Only, in her day, it was the Bush administration failing to do its job.

The story is the same, only the political parties are reversed. If Washington, DC had to deal with what the border states do, then they might wake up to the fact that there's a difference between legal immigrants who want to contribute to our society, and illegal immigrants who only want to take from it. :(

11. Fact: there have been more people deported under Obama...
Than under Bush. In fact this administration is setting an all time record. Arizona's problem with the Fed is that a Democrat is in the Whitehouse.

Here is some more factual stuff for you. NAFTA flooded the Mexican market with cheap subsidized Big Agra corn putting millions of Mexican farmers out of business. The few factories Mexico got in the deal did not provide enough jobs to make up for the loss of farming jobs. It seems to me that the moral thing for a person to do is to find a way to provide for his or her family, borders be damned. You would do the same if you had any brains and backbone.

I find your comment about whether or not illegal immigrant contribute to this society to be the height of ignorance. You don't know what these people contribute. You're just expelling flatulence from your oral cavity. I've met some of these people and they work hard and keep their heads down. They contribute much more to this society than the leeches in Washington and on Wall Street, whose policies brought these people here in the first place. You need look no further to find the sort of folks who only take from this society.

I can assure you that you haven't been hurt so much by Mexicans migration on the continent of their ancestors as by the policies of the people whose ancestors stole it from them.



Some people open their mouths and remove all doubt. You might want to think about that.

4. C'mon, when deportations have risen under both Bush and Obama
and border security spending has skyrocketed ever since the middle of the Bush admin? Clearly, this is a dog-whistle move not really acting out of law and order. Amazing how special interests like ALEC not the people's interests are behind much of the big name state legislation.

The dismissal Friday by U.S. District Judge Susan Bolton comes in a counter-lawsuit filed by Brewer as part of the U.S. Justice Department's challenge to Arizona's immigration enforcement law.

Brewer, a Republican, was seeking a court order that would require the federal government to take extra steps, such as more border fencing, to protect Arizona until the border is controlled.

Justice Department lawyers asked the judge to throw out the lawsuit and argued that federal court isn't the right place to consider the political questions raised by Brewer.

8. The constitution does provide for an independent judiciary. Bad idea? The articles of confederation
were better?

I'm not sure that giving southern and teabagger republicans the unchallenged ability to do anything to anyone without judicial review is such a good idea. Good for states'rights; not so good for human rights.

10. My perspective is that I'm glad that teabagger laws are subject to judicial review
that is independent from the conservative perspective that produced the law in the first place.

BTW this decision is to dismiss a law suit that Brewer filed in that court. Apparently she accepts the validity of the court system despite the fact that it is "elite and unelected". Isn't that a terminology that George Wallace used to condemn federal courts that overturned state Jim Crow laws?
