Police to shut down Occupy Columbia (SC)

I have been amazed, with what has been going on around the country, that we have had 20-50 orderly people on the Statehouse grounds since the beginning and relations between them and the police have been cordial. They put up the State Christmas tree yesterday, right where those holding signs had been posted on Main Street, so the Governor just announced at a 4:00 press conference that the state Department of Public Safety would close the site down and ask everyone to leave at 6:00. "Public health" concerns where listed as the reason. Don't expect violence but arrests are likely.

I am not in town to see it, but heard from some there that over 100 were on site before 6. Police waited 10 minutes, then said for all to leave. 5-10 minutes later, about 6-7 people had arms locked and they were cuffed and taken. No violence, give police some credit. Hope we are back in force tomorrow.

I think it's time for a RICO suit aimed at the Department of Homeland Security and the Governors and Mayors, who instituted their corrupt conspiracy to deprive these peaceful occupy protesters of their constitutional and civil rights; along with the police departments that illegally enacted their coordinated plan of action.

42 U.S.C. § 1985(3) - Depriving persons of rights or privileges

If two or more persons conspire...for the purpose of depriving, either directly or indirectly, any person ... of the equal protection of the laws, or of equal privileges and immunities under the laws...in any case of conspiracy set forth in this section, if one or more persons engaged therein do, or cause to be done, any act in furtherance of the object of such conspiracy, whereby another is injured in his person or property, or deprived of having and exercising any right or privilege of a citizen of the United States, the party so injured or deprived may have an action for the recovery of damages occasioned by such injury or deprivation, against any one or more of the conspirators.

42 U.S.C. § 242 - Deprivation of Rights Under Color of Law

Provides severe penalties for anyone, who, under color of law, statute, ordinance, regulation, or custom subjects another to the deprivation of rights, privileges, or immunities secured by the Constitution.
18 U.S.C. § 241

Rico would be easy to prove as the "leaders" have admitted publicly to being in on a conference call. The only question that remains is who instituted the conference call.

looks like 15-20 were arrested. They will spend the night in jail, and then some of the best lawyers in Columbia -all pro bono - will get them out in the morning.

12. final update, and good news
19 were arrested. They had their bails paid and are getting free legal representation. The good news: The Columbia Police Department refused the Governor's request to assist the State police in the arrests and to let them use the police paddy wagon because both the Mayor and the Police Chief said that they felt the arrests were illegal.
