The man identified as Juror No. 5 is the one who had been seen making a brief comment to the brother of Laci Peterson at the courthouse. The judge had indicated that the juror would be allowed to stay.
Speaking to reporters, the man identified himself as Justin Falconer, 28.Attorneys for the defense and the prosecution met with Judge Alfred A. Delucchi in chambers for more than an hour this morning before the judge announced the decision.
Falconer has told reporters outside the courthouse that it's "disappointing" to be removed, but that he's not upset. He said he understands that all the attention he's received made it necessary.
