State taking another step in BNSF diesel dispute

North Dakota Attorney General Wayne Stenehjem is optimistic about recent developments in the state's legal battle with the Burlington Northern and Santa Fe Railway.

Responsibility for and cleanup of diesel fuel floating on groundwater in downtown Mandan has been an ongoing issue between the two parties since its discovery in the 1980s.

An administrative order issued in 1985 that calls on BNSF to clean up the diesel fuel was reaffirmed in February by State Health Officer Terry Dwelle, but it was appealed by BNSF. The state will respond with a brief on the matter Monday.
